My dv2535ea was purchased in Oct 2007 from HP Direct. It failed on 18 May 2010 with a black screen on booting up. Initially I had no idea what the problem was, but after some time I thankfully found this forum. After a reflow of the GPU the machine worked again briefly so I managed to backup all my latest files since my last backup. The GPU problem soon came back though. At present, it exhibits as a green coarse graininess to the screen and an intermittent vertical black line. Sometimes during operation (playing a DVD say) the screen comes good, but on restart the same green tint and graininess is back. Does anyone else have this symptom?

I've just drafted a letter to HP Direct requesting a refund or replacement, but I wanted to ask: is it reasonable to limit my request to a refund only? Since I needed a laptop immediately my dv2535ea went kaput, I purchased another (a Lenovo - much better: it works!) I need another HP like a hole in the head :| (or was that wallet?).

You should have no problem there. For the majority of people their laptops are critical and not having one is not an option.

If you take a look at this link:- http://tinyurl.com/34gykjj you will see the BIOS update page for your laptop.

On the 8th April 2008 HP released a BIOS update for your laptop named F.2A. The purpose of this update is:-

Turns the system FAN on at the lowest speed, when the notebook is powered on.


Why, I wonder, did HP release this update for your laptop? Could it be to keep your laptop cool and stop it overheating?

Well done on your choice of laptop. The Lenova's are very well built laptops and in a different class to HP.

So, in short, you should have no problems in requesting a refund only. Besides, they will probably offer this as it will be the cheapest solution for them.

Just an update on my case...

Today I posted a copy of my engineers report (provided by Lapcure) with covering letter to HP. This is the third time I've written and have not heard a thing from them (although I know they've received my letters - isn't Track and Trace great!).

In my correspondence with HP, I've always explained that if I cannot get a resolution with them, I will take action through the Small Claims Court under the SoGA. However, I did pay by Credit Card for the laptop. Therefore my question is:

Should I go straight to Small Claims Court or should I go to my bank with a Section 75 claim?

There seem to be a lot of stories on here about banks contesting Section 75. Is it difficult to demonstrate breach of contract for a Section 75 claim? Is it therefore worth pursuing? I feel I have a good chance through the Small Claims Court. Any advice gratefully received.

HP's Customer Dis-Service department is great isn't it? I bet they would be quick to contact you if you were wanting to spend some money with them. Don't take their lack of response personal though, they seem to be doing that with everyone.

I would now contact your credit card company and make a Section 75 claim. You will probably also need to send them a copy of your engineers report but you should wait until they ask for this.

There is a template letter that you can send the credit card company in the downloads section of this forum and that is here:- Letter_to_CC-2.pdf

You should download that, edit it with your details and send it to the credit card company.

If the bank refuse to comply with their obligations, which in law they have to, then you should tell them that unless they comply they will be named as the 2nd defendants in your pending Small Claims Action.

They will not want to go to court to defend what is the indefensible so they will pay up.

In fact, you have more of a chance of a 100% refund from the card company than you would have from the retailer.

Thanks Paul for the advice. I'll wait till the 7 day period for HP to respond elapses (I don't expect a reply from them) and then write to my credit card company.

I'm posting an update on my situation, but there is little to report. Apologies to those hoping to take encouragement from my progress (sorry to Benny especially). However, I'm still hopeful of a resolution.

I wrote to my bank requesting a refund under Section 75. They requested further details, so I sent to them details of the purchase, copies of my unanswered correspondence to HP, and a copy of the engineers report. I didn't hear anything for 2 weeks, so wrote to them again requesting an update within 7 days. Almost by return of post I received a letter to the effect that the bank had contacted HP for their proposals as to how to resolve the matter. They will contact me before the end of December. I've been a loyal customer of my bank for many a long year, and I'm hopeful that they'll take this claim seriously.

If nothing concrete is forthcoming by the New Year, then I'll make a final request to my bank for a refund under Section 75, making clear that my next step is to pursue my Small Claims Court action, making clear that many folk have been successful with such actions. After that, the Small Claims Court awaits - and given the experiences of others on this forum, I'm confident that the Court will settle in my favour.

And so, I wait...!

You should also tell the bank that when you do issue your small claims action that you will name the bank as the 2nd defendants.

Unlike some of the retailers, they will not want to go to court to try and defend what is the indefensible.

I think that you will find that a resolution will soon follow if you tell them that.

Thanks for the update.

The deadline for my Credit Card reply expires this Friday. So far I provided them with proof of purchase and the engineers report. They may well request further information, I hope not, as this could drag on forever.

In an earlier post on here this morning someone provided e-mail address for the different company CEO’s. I was considering contacting HP; my only slight concern is that it may just confuse and deflect attention from my crusade against the Credit Card Co.
