You may have noticed that whilst there are a large number of success stories on this forum there could be more, considering the fact that we have been here for almost two and a half years now.
Well, the reason for this is due to the fact that a number of retailers are now forcing their customers to sign "non-disclosure agreements".
What is a "non-disclosure agreement" you may ask.
Well, this is where the retailer or their legal representatives make an offer of a resolution to the customer but on the condition that they keep the settlement a secret and do not disclose or discuss it with anyone else. The retailers also stipulate that if the customer does reveal that they have reached a resolution and have been awarded a refund then they will seek to recoup that refund from the customer.
How bad is that!
"Why do they do this?" you may ask.
Well, by forcing customers to sign non-disclosure agreements this means that other customers who are starting out with their claim do not realise that there is a real possibility of reaching a resolution because they do not see many success stories on here.
Rest assured though that there are many, many resolutions and refunds going on in the background and just because members do not always return to rejoice in their success does not mean that they have not been successful.
At the end of the day the law is on your side but maybe some of the retailers do not want you to know that.
Which is probably why some of the retailers give false and/or misleading information to try to dissuade you from making a claim.
It is an offence, punishable by heavy fines, for any retailer to give false or misleading information to a customer in order to remove or reduce their Consumer Rights or their rights under the Sale Of Goods Act.
So, don't be dissuaded from your claim because you do not see many success stories here.
Rest assured if I could reveal details here of the successes I would, but in order for the members to maintain anonymity I will remain quiet.
Despicable tactics on the part of the retailers concerned if you ask me and they should hang their collective heads in shame.
I just hope that the members concerned, of which there are many, never spend another penny with the retailers concerned.
