The important thing here is when you discovered it could possibly be an inherent defect rather than when it failed.

As you weren't aware of this at the time of the failure then they shouldn't hold it against you.

Bear in mind that the Statute of Limitations gives you 6 years to initiate a claim (5 years in Scotland).

I sent two LBAs to two different addresses and after the second one, a guy from Ireland called me. He repeated what the other woman said during the first call "The HP extended the warranty for 1 year due to this fault and informed it's clients about it. I did not take advantage of it so now there is nothing they can do for me and if I want, I can go ahead and report it to Standards of Trade (or something similar)."

I also told him HP was trying to keep this recall programme low-profile and so most customers never heard about it. In response, he tried to get me to say I knew about the programme but did not use it, but I kept replying I found out about it during the first call from HP's representative.
Furthermore, I got him to say something along the lines "HP never issued a refund or replacement machine to a customer with similar claim to mine" which I have recorded.

It does work, you could have visited at a time when everyone was filing their online claims against HP and Comet et al. :D

HP's handling of this is a joke and in some cases thoroughly dishonest. Some have even renamed them as "Hoodwink and Prosper"

I would waste no more time on this company and would now move onto the next stage.

It really is irrelevant what they think or say, what really matters is whether or not your laptop is inherently defective. If it is then you really cannot lose.

Well, they in fact confirmed the inherited damage themselves from the start and are denying the replacement only on the basis that I did not take part in the recall programme even though my laptop was on the list.
In the light of this, I think I could even skip getting the engineers report.

From the moment I submit the small claim form on this website, how long does it usually take for the case to be resolved? And when do I pay this 35 quid? While submitting?

Unfortunately this is one of those "how long is a piece of string" questions.

From the date they are served the claim they have 14 days to file a defence. They can extend this to 28 days by filing an acknowledgement of service.

Once the court receives the defence it will be transferred to your local court. The court will then send you an allocation questionairre for completion to both you and the defendants.

Once both of these are completed it goes before the District Judge who will allocate it to a "track" (more than likely the "Small Claims" track). You should then receive a hearing date.

There are currently rather large delays at a number of the courts so each of these steps could take a month or even more (it depends on which is your local court).

Thankfully we're now getting out of the holiday period so these delays should improve. However, bear in mind that there's currently no money available for court staff to work overtime to catch up on the work so it may take a bit of time.

Yes - at the time of submitting the claim you will be required to pay the Issue fee (this will automatically get added to your claim so you'll get it back from the defendant if you win.
