Just to let you know I used the template letters on Consumer Direct as guides and have sent one to HP and one to the credit card company (Co-op). I also included the letter to HP in with the one to the Co-op. Both got a copy of the engineer's report and were sent recorded delivery.

I'll let you know if I hear anything.

Dan

Hello Dan,

Good luck with this stage and I hope that they make a satisfactory offer without the need for you to take matters further.

Fingers crossed. :x

Best wishes

Hi Paul,

Just to let you know I had a call from HP Complaints on Friday asking me to send them the original order confirmation email, which I did.

The same person called me back today and said the matter has been passed to the legal team and I'll be updated with progress.

I'll keep you posted.

Dan

Hello Dan,

I cannot believe how long your claim has been ongoing, I produced your report back in January!

How did you get on with the credit card company? Did you write back and refute their original response to you?

Good luck with HP's legal team.

Best wishes

Paul

It was actually last August that you produced the report!

As per the letters on Consumer Direct, I wrote back to the credit card company and refused their response, along with writing to HP again (see the post from Aug 25th).

It took over a year for me to hear anything from HP.

Don't know what will happen next with their legal team but as I said, I'll keep you posted.

Dan

Hi Paul,

Another update for you, though not from HP this time.

My dad's been dealing with the Co-op (as the laptop was originally purchased on his credit card) and he said they have made an offer of 'between £400 and £450'. They've asked to see a receipt for the replacement (my Macbook Pro).

I'm assuming that this is completely separate from HP unless the two parties have communicated.

Dan

Hello Dan,

That is excellent news. :! :! :! :!

Their offer will be for the HP laptop that has failed and will, no doubt, be in full and final settlement.

Did they state whether their offer includes your consequential losses?

Best wishes

Paul

Hi Paul,

It is good news, though the offer from the Co-op didn't mention consequential losses.

HP rang me on Friday and offered me a free repair. I refused and said this has been going on for over a year now. The guy said he'll note it and I'll be contacted again soon. No doubt they'll improve their offer.

I've told the Co-op I'm waiting on HP at the minute. I'd rather HP coughed up as it's not the Co-op's fault.

Hello Dan,

You should be careful that you do not accept a lesser offer from HP as the Co-op's offer of £400 to £450 was quite good considering the usage you have had.

It is unlikely that HP will offer a refund and at the very best they "may" offer a replacement laptop, though that is not guaranteed.

To be honest, whilst I appreciate that you say that it is not the Co-op's fault I would be inclined to accept their offer.

Let's see what HP say.

Finger crossed for you. :x

Best wishes
