Already had my report done by yourselfs, and we all know what the problems are. My laptop cost £479 in Aug '08, so what kind of settlement deal should be accepted? (Tesco) :nh

Hello Mkimp,

Based on the information in your profile the minimum that Tesco should be offering is £279.

This is based on the fact that the laptop should last as long as the Statute Of Limitations, which is six years.

Good luck, though judging by the experiences of some other members you may be in for a bit of a battle.

But like I have always said, persistence is the key to success. Don't let them fob you off, don't give in, stand your ground and you will succeed.

Did ring the the electrical customer services out of interest to see what the response was...."Nothing to do with us after a year, you will have to contact the manufacturer" :b ....I told him he was wrong and put the phone down.

What absolute baloney.

I wonder where he was on training day as he obviously either wasn't present when the subject topic was the Sale Of Goods Act?

More evidence to support my advice that you should ignore virtually all of what they say as it is either inaccurate or a complete fabrication of the truth.

You have stated that you have already obtained a report from ourselves. Have you already sent them a copy of the report along with a letter before action?

Once you have completed the form and sent it I would then chase them up and would tell them that your letter before action overrides their OOW and you should remind them of the deadline for them to make an offer.

Don't let them keep you hanging on for weeks. Make sure that you take control of the timeline and if they refuse to comply then you should sue them.

Sorry, I will back track a little. Once the screen had gone I asked a guy who I delivery to (M.A.S Computer Systems in Bedfordshire) if he could take a look at it. He was aware of the chip issue and recommended I send it to yourselves for a report. It came back working, plus the report. It lasted for 3 days until the screen went again. I then got proof of purchase (Visa statement) and searched the net to find out what my best appraoch would be. I found your site, decided to download the OOW form and sent that along with your report and my proof of purchase to Tesco. This will be my first contact with them, and hope by sending the report now MIGHT stop them trying to stall me. Playing the waiting game now. :w

I think that most of the retailers are all over this forum like a rash.

I know for a fact that one retailer certainly is constantly on this forum as they knew of the advise one customer had received.

Not that it mattered because the retailer had a small claims action filed against them and had to settle at mediation.

I think it would be foolish of a retailer not to take a look here, at least then they can see the level of disdain some of their customers have for them.

Sorry, been away for the week. Response is a £195 "goodwill gesture". I find this figure somewhat spooky, a sort of halfway house between the £279 you state Paul and the standard £150. Coupled with the now 500+ post views (Hello Tesco :roll: ) I feel this is a dangly carrot offer, which is just not going to work. Next step?

They really do mean it when they say every "little" helps don't they!

I would contact Tesco and would tell them that their offer of £195 falls way short of the £279 that you are entitled to.

The £279 is based on the laptop lasting as long as the Statute Of Limitations, which is six years. Even if we were to base it on five years then their offer should be at least £239.

I would tell them that unless they increase their offer then you will have no option but to file a small claims action against them.

i would also tell them that you are well aware of all the successful claims against them and other retailers so you are more than confident of a successful outcome.

See what they say. If they increase their offer then great. If not then you should simply sue them as you are in the right and Tesco are in the wrong.
