Hi Paul,

Well just been to court and won!! Tesco defence was that a free repair had been offered by Dell with a 5 year warranty and hence the offer of 180 pounds was reasonable as compensation. After a relatively lively discussion about the details of the case the judge awarded me £300 pounds for the laptop and inconvenience caused to me, along with all court costs and the engineers report. I was also awarded loss of earnings for the attendance at court so walked away with just over £550 all in.

A good result and well over the £180 offered initially. I am still not sure why retailers bother to incur the costs of pursuing these to court.

Thanks for your help and the really useful templates and guidance on this forum. The process is not that difficult but the thing i find frustrating is the time it takes to resolution. I first contacted tesco in Dec 2010!

It astounds me that some retailers are still fighting against their customers with regard to this as the evidence is there for all to see.

I am glad that the judge saw sense and that justice prevailed. :! :! :!

Like you quite rightly stated, a much better result than the initia l £180 which was offered.

I decided to drag my nvidia defective Dell laptop 9400 (cost £1,800 and has sat on the shelf for some time) out today to see if was any better. Of course it is the same screen problems and the laptop trying to cook itself despite the bios updates & a cooler. I had no idea the nvidia problem was so extensive and serious until I hunted around the web today. The reporting by the Inquirer is good reading & reporting. I was fascinated to read of the US class action against nvidia, their insurer refusing to support claims against nvidia, nvidia's out of court payments to OEMs, $10,000,000 to Dell.

I called Dell support today for help but got the brush off - out of warranty - can't
help unless you want to pay £180 for a repair. No thanks.

I have legal protection insurance so I will try to get them to take up the case for myself against Dell UK.

Btw my card is 256Mb 7800 go
