Hi, after coming across my old 6735s laptop which failed nearly 4 years ago I decided to see if I could find out if there was any way of rescuing her. After 'googling' the problems (blank screen with caps lock flashing 5 times) it unfortunately looks like it is the 'dreaded' BGA problem, albeit the ATi kind, but it looks like you guys might be able to help me.

I purchased the 6735s laptop from ebuyer on 12 March 2009 and it failed on 30 March 2010. I actually gave ebuyer a call the following day and remember being told that it was outside the 12 month period etc etc, and there was essentially nothing they could do and just fobbed me off with excuses. I tried in vain to revive the laptop, to no avail and put it back in a box in my wardrobe where it has been since.

Now, I appreciate that the laptop is nearly 5 years old and I may stand to get a small portion of the price paid back, however, not only did it fail after only owning it for 12 months, but I also contacted ebuyer.

What is the best way to launch a claim given these facts? If they were to get it to fire up they would see that it has not been used since the date it failed.

Hello and welcome to my forum.

Sorry for the delay in my response.

Do you have any evidence to prove that you reported the problem to Ebuyer when the laptop initially failed?

The reason I say this is because if you don't then Ebuyer will only use the latest date that you reported the problem as being the actual date of failure.

The fact that the laptop was outside of the 12 month warranty is wholly irrelevant and Ebuyer really should know this.

The fact that the laptop failed so soon after the warranty expired means that it failed the Sale Of Goods Act 1979 insofar as the laptop was neither durable, free from minor defect and nor did it last a reasonable period of time.

I would now give Ebuyer another call and would tell them that your laptop has failed due to an inherent defect with the BGA underneath the ATI GPU.

When you call they may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you to contact HP. You should tell them that you purchased from Ebuyer and not from HP so it is entirely Ebuyer's responsibility to resolve the situation.

See what they say. If they say they will inspect it for a fee you should refuse and say that due to the "reverse burden of proof" then you will provide your own independent engineers report.

If and when they do please let me know as this is a service that we provide.
