Hello Roberto,

Well that is really good news and is the first time I have known of a manufacturer, retailer or credit card company to based a refund on a ten year life expectancy.

I would therefore accept their offer, though it is worth requesting that you are also reimbursed for your consequential losses.

The cost of the report plus the carriage costs that you incurred would add up to over £100 which is by no means a small sum and why should you have to bear this cost.

The statement at the end of their offer letter is pretty standard and to be expected so I would not worry about that.

It has to be worth a try and I would guess that the credit card company would not be willing to go to court to defend this as it would be too costly for them so if they believe that you would sue for this sum then they may just capitulate without too much of a fight.

Fingers crossed that they do as their offer including costs would be a most excellent result. :x

Hi Paul,

Finally a reply from RBS.

They have agreed to pay all consequential losses and have apologised for not including them in the previous letter, evidently they have too many people dealing with this case.

The letter states (again) that if the offer is agreeable, to sign at the foot of the letter and return it, "arrangements will then be made to apply the credit to your account."
Does this mean that the credit will be applied to her credit card account? Can she request that the credit be paid into her bank account rather than reducing the debt she has on her credit card account?

Hello Rob,

Technically if there is an outstanding debt with the credit card company then they "could" use the refund to offset against the outstanding balance.

However, when returning the letter your relative should sign it stating that the refund should be paid into her bank account rather than her credit card account so that he can use the refund to purchase another laptop.

She should sign write something like the following on the letter:-

"I accept your offer of settlement on the sole condition that the refund is either paid into my bank account or is sent to me via a cheque. If this is not acceptable then please do not refund to my credit card as this would not be acceptable. My bank account details are as follows:-...................."

That way if they do refund to your credit card then they would have breached the contract.

My cousin managed to speak to one of the officers by telephone at RBS dealing with the case and they have agreed to send a cheque once they have received the signed document. It is winging its way to them, will let you know when the cheque arrives and the celebration can begin.

I hope you will accept my sincere apology for not informing you of the final outcome with RBS credit card company.

Finally at the beginning of the New Year the money was deposited in my cousins account £912.75 this included £112.75 for the losses incurred. I can't thank you enough for your help and of course the excellent report that you provided and going the extra mile.

It has taken 6 months to get this sorted out but without your help we would never have had a resolution.

To all on the forum.....keep up with the fight, it's worth it in the end.
