I bought an inherently defective Dell Inspiron 1720 in July 2008 as a business to business transaction and when I upgraded to W7 in September this year, the laptop would not boot correctly.

On finding this amazing forum I pursued a claim against the retailer (MCS Technology) using the outstanding step by step guides and Paul's immense knowledge. Of course the retailer played all the "not in warranty" and "bought as a business so Sale of Goods Act is irrelevant" cards but, with the law firmly on my side and being persistent in my claim the retailer finally buckled under threat of court action and offered me £150 as a part refund (laptop was worth £159 according to the refund calculator found on this forum). I bit his arm off!

Cheque received last week which I have put towards a new laptop. Moral of the story is - persistence! A lot of retailers will think they have the law covered under SoGA and that is enough to frighten us off but as consumers we have more power than they think! Keep plugging away and you will succeed like I and many others have.

I couldn't have reached this result without finding this forum and having Paul's excellent knowledge and patience in helping me with my claim. So many thanks to him.

It amazes me how many retailers consistently try and fob their customers off until they realise that the customer is serious about filing a small claims action at which point they soon change their stance.

Whilst business to business sales are generally not covered by the Sale Of Goods Act there are other avenues that can be pursued such as suing the retailer for damages.

I am really pleased that you did not have to go that far so that is a blessing.

I am also pleased that you found my forum and that I was able to help you reach this positive resolution.
