Looking for some advice I have a sony vaio laptop VGN-FZ21M purchased from John Lewis 24/02/08 which has now developed the dreaded NVIDAI inherent defect, 27/03/12.

So far following your advice I have tried to return to branch where i purchased, only to be told, as expected out of warranty, so wrote to head office who refered back to branch department manager, who then called to offer me £150 refund or a fix but no written guarantee (even before I produced a engineers report). I refused and produced the report only still to be offered the same options.

I dont think £150 is quite good enough considering I'm a light user, I would expect a laptop to last longer than 4 years if it is looked after. The other option of a fix - which you don't recommend without a guarantee. Do you think i should now continue on with head office and try for a little more or is this a reasonable offer your calculator says £207.

Think all your advice is brilliant, don't know how all these big companies are allowed to get away with not stepping up and dealing with the issue. The fact that we were all buying these laptops after they knew there was a big problem is disgracefull.

Sorry to hear that your laptop has failed.

The offer that you have been made is below he minimum that your are legally entitled to which is £207 based on the usage that you have had.

You can pursue John Lewis for the extra £57 but even if they do pay you this amount it is not going to buy you a laptop of similar specification or quality.

As Sony have admitted to the defect in your laptop then John Lewis will probably be refunded by Sony for any resolution that is offered so I would be inclined to push John Lewis for a replacement laptop.

I would send John Lewis a letter before action stating that you want a much higher refund as you were only a light user or you want a replacement laptop and that if they refuse to offer either then you will pursue them through the Small Claims Court.

If they capitulate then great. If they refuse to budge then you should sue them for a resolution. As your laptop is inherently defective then you really cannot lose.

Stand your ground and be persistent and you will be successful.

Whatever you do don't let them fob you off.

Here we are 6 months after I reluctingly agreed for John Lewis to fix my laptops graphics card it has now gone again as you said it would. I guess that is it I'll have to buy a new one.

Sorry to hear that your laptop has failed again.

No, no, no, you will not have to buy a new one.

John Lewis are still liable to you as it is patently obvious that the repair was undertaken using parts which were not of satisfactory quality.

I would advise that you get back in touch with John Lewis and would tell them that your laptop has failed again due to the same defect which you originally reported.

I would also tell them that it is patently obvious that your laptop cannot be repaired (due to the re-failure) and that you now want a refund or you will pursue a Small Claims Action against them.

Don't let them fob you off and if you need any help or advice then please let me know.

You have a very strong case so stand firm and be persistent and you will succeed.
