for some reason the Tesco section won't allow me to post, so just an update
(Paul presumably you'll move this)


They are taking me the full distance and have closed their file, despite me sending a "letter before action" so it would be almost rude not to open a small claims action

How scandalous is that!

What makes them think they can ride roughshod over your statutory rights and your rights under the Sale Of Goods Act?

I would waste no more time with them and I would issue a small claims action against them.

Remember, they sold you an inherently defective laptop that was doomed to fail prematurely from the day you purchased it.

They are in the wrong and you are in the right and you should go forward with that in mind.

Pop on over to http://www.moneyclaim.gov.uk and issue a small claims action against them.

We will then see how quickly they will re-open their file.

What absolutely atrocious customer services.

They really do mean it when they say "every little helps" because it sure was a little that they were offering you.

What really makes my blood boil is where they say:-

How dare they treat you with such disrespect!

They are all nice and smiley when they are taking your money off you but it is times like this that you see them for the second rate company they really are.

They seem to offer £152 to everyone who has purchased one of their defective laptops irrespective of how much they paid for it.

If I were you I would have my day in court and them invite the press to run a little story in the hope that it will open the floodgates of complaints against them.

Another thing is why haven't they refunded the cost of the engineers report?

They asked you to provide this didn't they?

In any event it is what is known as a direct consequential loss and they HAVE to refund you.

Another thing is, why are Tesco saying they will not be reimbursing you for the cost of the engineers report?

That's not on, especially because they requested you to provide one for them. A general piece of advice is that if a product is inherently defective and an engineers report is required to prove so, the cost of which will have to be refunded. No questions asked.

I completely agree with Paul, and you need to go ahead and make a claim, like I did today for my laptop! Its very easy! :P

claim submitted 68 days from failure date; they have 14 daysfrom 29/3 to respond

They actually didn't ask me to obtain an engineers report, they refused point blank to accept it was an inherent fault, as I had said if you don't I will obtain an engineers report (under reverse burden of proof) and prove it was an inherent fault

Why have I done something wrong? I used your template for the claim issue as follows they have 14 days to respond. I forgot to charge them £1.14 for postage(bum)

I purchased my laptop on 20th April 2008
from Tesco Stores Ltd. On 20th January
2010 my laptop failed due to an inherently
defective Nvidia GPU. I researched the
problem and found that his issue is
affecting thousands of laptops worldwide
and is a known fault.
I have obtained an engineers report, of
which Tesco Stores Ltd has a copy, which
confirms the defect in my laptop.
I sent a letter to Tesco Stores Ltd
requesting a refund,replacement and that
they comply with the Sales of Goods Act but
to date have not had a favourable response.
Having exhausted all other means possible I
am now forced into this action. I am
claiming the cost of the laptop, engineers
report and other costs totalling £514.00
I also claim interest under Section 69 of
the County Courts Act 1984 at the rate of
8% a year from 20th January 2010 to
28th March 2010 of £5.44 and also interest
at the same rate up to the date of judgment
or earlier payment at a daily rate of £.08

Hello Cushley,

You haven't done anything wrong and were quite right to obtain an engineers report. How else could you have proved that your laptop was indeed inherently defective?

The fact that they refused to accept that there was an inherent fault adds credence to to the fact thqat you had to obtain a report.

The claim you have filed is perfect. It is just a matter of time now.

Just got the same problem bought from tesco direct 18 months ago , ive filled in their defect form. Have you an update on your claim / small claims court ?? have a look on http://www.nvidia.com/object/io_1215037160521.html they actually accept the defect
