Has anyone here successfully taken Dell to Small Claims Court in the UK?

I notice that my invoice is actually from 'Dell Products' in Ireland - does this mean I'm out of luck?

Even if I win, I'd then have to collect a judgement from them in Ireland!?

Has anyone had any success with any other options? They've already refused to do anything via email and in response to a written letter I sent them.

Hello Stormeagle,

I don't know of anyone who has taken Dell to court, but that could be because they have settled before it got that far.

You are not out of luck because it says Dell Ireland so no problems there.

If you did win then yes, you would have a judgement against them but once they get the court documents I would bet that they offer a resolution quite quickly.

Was it a letter before action that you sent them?

If so it is now time to move onto the next step which is the engineers report. Once you have that you should send a copy to them along with a final letter before action.

If, after seven business days, they have failed to respond then I would file a small claims action against them.

If your laptop is indeed inherently defective then you really cannot lose.

No, this was just a formal letter giving them a first chance to doing what the guy on email didn't.

I'm not sure this is correct? My original invoice says "Dell Products", registered in Dublin. Despite Dell's presence in the UK, I've essentially done a transaction with a foreign company (not sure how one is supposed to know this before paying, but that's another issue).

I'm not even sure I can take them to UK Small Claims Court, but if I can, I'm not even going to be able to collect the refund/costs!

EDIT: If I take Dell UK to Small Claims Court, they can just (correctly) say to the judge that I have no transaction with them. End of case.

Did you buy it on line? If so then do you have a copy of the terms & conditions?

Dell's current t&c's have the following clause:

17.1 This Agreement is to be interpreted in accordance with English Law but may be subject for Consumers to the jurisdiction of the English, Welsh, Northern Irish or Scottish courts at the claimant's choice. For Business Customers the English courts shall have exclusive jurisdiction.

If this applies to you then you've got nothing to worry about :D
