I received a cheque from Comet this morning for £904.99 :D

I bought an HP DV2799ea from Comet in April 2008, and it failed about 18 months later due to the Nvidia defect. I contacted Comet to see if they were prepared to do anything to resolve the problem and was told that as it was out of warranty I needed to contact HP. I'd already checked to see if it was covered by the Warranty Service Enhancement, but I called them anyway, and they told me a repair would cost about £270.

I really didn't want to line HPs pockets any more than I already had, given that the laptop was inherently faulty; so I got an engineers report from Paul and tried to reason with Comet. After 2 letters to Comet, the best they could offer me was a free repair; by this time I'd already bought a replacement (a Sony with an ATI graphics chip!), so a free repair was no good to me.

I filed a claim against them on 22nd December for the cost of the laptop (£779.99), plus an engineers report (£65) and court costs (£60) and they failed to file a defence within 28 days; so I requested judgement by default, and won!

Many thanks to Paul for going to the effort of setting up this forum and providing me with the guidance I needed. If he hadn't, I probably wouldn't have thought it was worth the bother of making a claim, and I would have paid to have it repaired. Seeing that other people were having success gave me the incentive to take it further, and I'm now £780 better off for it.

Well done on your success.

Comet must be getting sick of the site of the court summonses by now. :D

A lesson for others, don't ever be afraid of filing a small claims action against Comet.

Chances are they will either not file a defence, not reply to the court documents or they will not turn up on the day.

Even if they did turn up they cannot possibly win if your laptop is indeed inherently defective.

It is successes like this one that confirms to me that setting up this forum was the right thing to do.

Well done again and best wishes for the future.

Ummh not sure about that one... they are a pretty dopey bunch, they receive a report which details amongst other things, that the notebook/laptop is practically melting before your eyes, and they think this is OK and fit for purpose... so a piece of paper with court summons on it, they probably think its an invitation to lunch or something :roll:

Been looking at the list of Comet successes, we may have enough people to form that band now...

Watchdog here we come.

Am reading up on these as am not having much luck with Comet - they've filed a defence against my whole claim and I am now in the process of completing an allocation questionnaire.

Don't worry about Comet filing a defence, they have done this many times in the past and have either lost or capitulated right at the end.

Please can you post their defence points here and I will advise further.
