I am so glad to have found this site and well done on the wonderful job you are doing for us small people.

My story so far

I was offered partial refund from the on line retailer just before Xmas without obtaining an engineer‘s report, but I asked them if they consider replacing it being Christmas and so on and they said no (surprise, surprise!!!)

I had to be out of the country for a few weeks and on my return beginning of March sent them an email asking for their method of calculation and if they allow me to keep the laptop or the hard drive and if not will they provide certificate of destruction to which they did not reply, Sent 3 more emails no reply.

Then I sent another Email telling them that I have the right to ask these questions and if they do not reply within seven days, I will have no choice but to obtain an engineer’s report and go to court, that was five days ago and still no respond.
What do you think is their game and what should I do next. Have I lost my rights as at the time of the offer they said to let them know by return?

Hello Imo and welcome to our forum.

Well, after already making you an offer I cannot understand why they are suddenly sticking their heads in the sand.

Have you considered phoning the retailer? It could be your email is either going to spam or to the wrong person and so is not being actioned.

Who did you purchase from and how did you pay?

Please let me know and I will advise further.

It was bought by someone less for me from Dabs and he doesn’t remember how he paid, and even if it was C/Card I thought they will only get involved if the retailer does nothing.
He sent them the first email asking them to deal with me.
I have sent copies of my last Emails to the person I have been dealing with and to the customer services on their web site.

Hello Imo,

In that case I would give them a call tomorrow and would tell them that unless they make you an immediate offer of a resolution then you will have no option but to obtain an engineers report and to then use that as evidence in the Small Claims Court.

I would further tell them that as they have already made you an offer of a resolution then there can be no reason for them to now become incommunicado.

If they refuse to comply then you should proceed with the next step in the step by step guide.
