Hello Rich,

I then asked if they wanted an independent report and they said they would waive the £50 but still needed the laptop to be sent off to them for inspection.

That is strange don't you think?

Firstly they want to charge you £50 to inspect the laptop but when they realise that you know your rights and wish to provide your own report they suddenly change tack and offer to waive the £50 fee. If they can waive this fee so easily why do they try to charge it in the first place?

It is up to you whether you choose to send it to them for an inspection or not. If you choose to obtain your own report then please let me know as I can help with that.

Either way it looks like you are moving forward with your claim so that is good news.

Any questions please let me know.

Best wishes

Hi Paul, I do want to get a report and send it along with the laptop. Do you know if postage can be claimed back for sending to Pc World and will they return the laptop after an agreement is reached?

Hello Rich,

The cost of the report is fully recoverable from PC World as it is a consequential loss so you will not have a problem there.

If PC World want to inspect the laptop after you have had a report then you should tell them that they should pay to collect it from you, unless of course it is easy for you to take it to one of their stores.

Please make sure you keep a record of any costs incurred, such as postage of letters etc as these amounts should be added to your claim.

I hope the above helps.

Any questions please let me know.

Best wishes

Paul

Hi Paul,
Some news:

We have been offered £270 with a confirmation of the Nvidia fault after sending the laptop for inspection. I will be copying your invoice and sending it to them via email so I haven't yet accepted the offer and will be ringing them back soon.

Hello Rich,

Please could you let me know the purchase price and the date of purchase plus date of failure and I will calculate whether their offer is reasonable or not.

At least you are now moving forward and they have concurred with my findings.

Best wishes

Hello Rich,

Based on the information you have supplied I have calculated that the minimum refund that you are entitled to is £282.86. This is based on 38 months usage and 34 months non-usage.

So their offer of £270 is just about in line with what you would expect to receive (give or take £12.86). You could always try squeezing them for a little more but at least you won't have to proceed to litigation.

Best wishes

Hi Paul,
Yeah I could get in a haggle over the extra but I am going to accept the offer tomorrow. I just want to say thanks for all your help with this issue as it brought some good out of a bad situation.
We definitely need more forums as helpful as this one

Hello Rich,

Thank you for that, much appreciated.

I am glad that you managed to reach a resolution, which was much better than a lump for a doorstop.

You may also be able to keep the laptop. If you can then that should fetch a reasonable price on Ebay in its current condition.

If you have to give the laptop back then you may want to ask to keep the hard drive, for privacy and data protection reasons. Then all you would need is an external caddy, for about £15, and presto, you have an external hard drive. :D

Well done Rich!

Best wishes
