Well, to actually receive a response from them in the allotted time would be nice, thought that would probably be asking too much.

They will probably say something like:-

"After discussing the matter with Sony I can advise that Sony state that your laptop is not one of the affected models"

Or some other baloney along those lines.

If it is not on Sony's "list" then, according to Sony. it cannot possibly have the defect.

Well, all I can say is that I have worked on a huge number of Sony laptops that were not on their "list" and they all had the defect.

Whatever they say accept no baloney and don't let them fob you off.

ALMOST THERE

Well to my surprise a response from DSG arrived today and it was good news. Unfortunately my scanner only worked on my laptop but a summary of what they said is:

They accept that under Scetion 14 of TSoGA goods must be of satisfactory quality but do not agee that Section 14 stands alone.
They state that under Section 35 after a reasonable period of time the buyer loses his right to obtain his money back. They consider this "reasonable time" to be within days of purchase.
It is their opinion that I have retained the goods for a reasonable amount of time and am therefore not entitled to a full refund.

I was not surprised by the above.

Nonetheless they accept the laptop failde prematurely and are prepared to offer me a depreciated credit that takes account of the use I have had. :D

SO THATS THE GOOD NEWS

They have based their calculation on a 4 year life span therefore stating I have had 23 months of use which leaves a balance of 25 months.
They have therefore offered me £276.05 by cheque, or £350.00 in gift vouchers.

I feel their 4 year life span is a bit low and they certainly dont tell their customers they on expect the useful life of their laptops is 4 years.
I am also a bit loathe to take vouchers as it forces me to go back to PC World. I have to use this money to buy a new laptop and they don't sell the one I have spotted as a replacement.
They have also not included the cost of my engineers report, which although was only £20 makes a bit of difference.

I am tempted to write back and propose a cheque for £346.81 [(£529.97x 37/60)+£20] would be more in order.

Your thoughts?

Hello Earl,

Well, their 4 years life expectancy is too low and should be revised to 5 years as this is the accepted term and is one used by the courts.

I agree with your calculations and would put that to them and see what they say.

You are certainly moving in the right direction though.

My polite declination of DSG's intial offer has been sent. I have requested £346.81 by cheque as a counter offer to the offered £276.05.

Let us see what they say. At least I know I will be getting something with out the possible need to go to court. Thanks again for your assistance.

Good luck with that, it makes sense for them to pay you an extra £70 now rather than £70 plus court costs if it gets that far.

Have just received a cheque for £346.81 for, in their words "by way of a compromise". Interesting that a compromise to them is to give me what I asked for.

A big thanks to you and your team for all your help, I wouldn't have known what to do without this site.

A lesson to all....the message is obviously getting through, and all it takes is a couple of letters and some confidence.
