Hi there,

I'm new to the forum and need some advice. My Sony Vaio NR21Z's Nvidia 8400M GT appears to have failed today (lines across screen and heavy pixelation etc.) I purchased the laptop from this company through their ebay shop: http://www.telephonesonline.co.uk on 18/09/09 and paid through PayPal. It was a refurbished unit.

Worryingly, it looks like they no longer sell laptops. I am wondering what my options are as far as solving the problem. Am I right in thinking the 8400M GT is among the defective chips? Any help would be greatly appreciated!

Sorry to hear that your laptop has failed.

The fact that the company no longer sell laptops is irrelevant. If they are still trading, irrespective of what they are actually trading in, then they are still liable.

The 8400 is one of the more prolific of the defective GPU's so coupled with the problems you have mentioned I would say that it is highly likely that your laptop is indeed inherently defective.

It is now time to stake your claim with the retailer.

You should contact them and should tell them that your laptop has failed due to an inherent defect with the Nvidia GPU.

They may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you that they only sell phones. You should tell them that is irrelevant as they are still obligated to you irrespective of what they sell now.

They may then tell you to contact Sony. You should tell them that you purchased from telephonesonline.co.uk (Communications And Trading Limited) and not from Sony so it is entirely telephonesonline.co.uk's (Communications And Trading Limited) responsibility to resolve the situation.

Hi Paul,

Thanks for your advice, really helpful. Just spoken to the company and was told it is our or warranty etc. etc. He also mentioned that the laptop was refurbished so there was nothing he can do. I presume this shouldn't affect my rights for a refund/replacement. I'll be proceeding to send the letter template to their head office. I'll let you know how it goes

Take absolutely no notice of them when they say that. It does not matter that the laptop was refurbished, it still has to conform to the Sale Of Goods Act.

Hi Paul,

Apologies I have been away this long, univeristy commitments have meant putting my claim on hold. However, after sending your letter template to the retail they advised contacting Sony. I refused, and they are now asking to send the laptop to them with original operating system and invoice. Again, I have refused so will need to obtain an engineers report. I'd like to do this through yourself if possible? My only worry is that having not used the laptop for some time the pixelation appears to have disappeard, although I presume your tests will still pick up the defect. My laptop also has a different operating system to that shipped, but again as this is a hardward problem this should be irrelevent.

If you could give me details of your reports I would be grateful.

Hello George,

I would not recommend sending your laptop in whilst it is in a working state as it is almost impossible to prove the defect if it is not manifesting itself at the time of testing.

I would suggest that you continue to use the laptop until such time as the corruption re-appears and would then contact us and I will arrange to provide you with a report.

Experience tells me that your laptop is on the fringes of failure so it shouldn't be too long before it fails again.

Sure enough after running the laptop for only half an hour this evening I am back to the same 'gridded' poor resolution pixelation I had been previously been experiencing. No surprises there.

Apologies it has taken me this long to inform you of where I am to. We've been forced to claim against the retailer and have just had a response from the defendant. I'm in need of a little advice with how to respond to the forms. Would it be possible to scan and email them to yourself you can have a look over them? I appreciate you're a busy man but any words of wisdom would be highly appreciated at this late stage of proceedings.
