Hi guys hope you can advise me a bit. Basically I bought a laptop (dv9605ea) from Dixons after seeing it via HUDK - http://www.hotukdeals.com/item/237971/h ... -h?page=33

I should point out at this stage that the laptop is refurbished but Dixons claim them to work as new.

I purchased the laptop in September 07 and have had no problem other than overheating. Until recently that is. Now after shutting the laptop 90% of the time I reopen it the screen is either totally black or unreadable. This leads me to believe I have the same issue as most.

What should my first step be with regards to getting it sorted? Will it be exempt from the sales of goods act as its refurbished?

I really don't want to have to throw it out and buy a new one if at all possible as I can't afford right now.

Hello TCO200 and welcome to our forum.

Sorry to hear of the problems you have been experiencing with your laptop.

The fact that it was a refurbished model doesn't make any difference whatsoever you still have your rights under the Sale Of Goods Act.

I would contact Dixons and tell them that you believe your laptop is inherently defective due to the Nvidia graphics chip.

They may tell you that you are out of warranty or that you should go to the manufacturer. Where goods are inherently defective you have SIX YEARS from the date of purchase to take action against the retailer, furthermore you should never waste your time going to the manufacturer as they cannot help. Your contract is with Dixons and it is only them that can help.

They may tell you that you will need to prove that your laptop is inherently defective and request that you provide an engineers report.

If and when they do this please let me know as this is a service we provide.

Start off by contacting Dixons and see what they say and then let me know so that I can advise you further.

Ok spoke to dixons and the guy told me to contact head office and he can't do anything.

Should I now write the letter to them?

Yes, send them the letter before action which is available in the downloads section of this forum.

Don't forget to send it by recorded delivery and keep a copy of the letter and postal receipt.

I have now sent the letter but could you please advise, my laptop is now working at the moment but only after repeatedly trying and urning it on and off.

Does this still sound like the same problem and should I wait till it goes fully to act further?

I wouldn't wait for it to fail - why should you?

As long as we can prove it is inherently defective then you have nothing to loose.

It does sound like the same problem, but only an inspection of your laptop will prove that 100%.

Cheers Ralph, luckily I've recently bought a Maxtor external HDD so I've backed all my photos and music etc up.

Letter sent this afternoon recorded delivery, I suppose all I can do now is wait

UPDATE

Dixons rrang me and have asked me to take the laptop to a local PC world for a diagnosis rather than getting an independant report. Not too confident on this now especially seeing as I seem to have an unrelated problem in which the hinge suddenly snapped on the laptop for no reason

I suppose I may as well take it to PC World to find out

Hello,

Under no circumstances should you let them do a diagnostics check.

The law states it is up to you, the customer, to prove that your laptop is inherently defective, it is not up to PC World to prove this on your behalf.

I have seen far to many laptops that have already had a "diagnostics" report and the result was either a failed motherboard or major component failure.

You should reject their offer and instead tell them that you want to provide your own engineers report.

They cannot refuse this and they have to pay for it.

Don't let hem fob you off as they have no option but to accept an independent report.

The successes we have reached have all been as a result of the reports we provide.

I note you mention that the hinge on your laptop has snapped.

I bet it was the left hinge.

If the Nvidia defect weren't bad enough the DV9??? range also suffer from a defect on the hinges where they break the back lid.

Another reason why you should have a refund - something, in my opinion, you will not get with one of PC World's reports.
