They weren't budging with a few other forum members until they filed their Small Claims Action.

They then offered a settlement.

It is all about persistence Shazzer, don't give up on this, get that fire burning in your belly and take them on.

Shazzer,

Just to confirm what Paul has said - costs are severely limited in the Small Claims Track at the County Court and would only normally be awarded against a claimant if their claim was found to be vexatious (ie: you issued a claim with no reasonable chance of success solely to cause difficulties for the defendant).

Hello Shazzer,

No problems with helping you, that is what we are here for.

As it now seems that you have reach a dead end with the retailer your next step is to proceed with the filing of your small claims action.

To start the claim you should go to www.moneyclaim.gov.uk

There is a step by step guide on how to complete the online claim and that is here:- topic163.html

Some of the screens in the online process have changed slightly from the guide but all the information is there to help you.

Whilst completing the online guide there is a section entitled "particulars of claim". It is here that you write what you are claiming.

As a help I produced the following guide:- help-on-what-to-enter-on-the-small-claims-court-form-t339.html

After you have filed the claim you should then sit back and wait to see if the claim is defended. If it is then don't worry, we will help you with that.

If they defend the claim then you will receive a copy of their defence along with an Allocation Questionnaire from the courts.

Don't worry Shazza, you are not alone and we will all help you reach a resolution.

Remember, the law is on your side. I realise it can seem daunting, you against Tesco, but remember, David did beat Goliath!

Hi,

My mam's laptop (G6062), bought in August 2008 went in early December 2010.

Following the more than helpful advice on here not only did I get my mam a full refund of £359 they also refunded my £20 Engineer's report.

Also, my mam still has the laptop which can be used for parts.

My steps were:

Contact Tesco Customer Services and request a Out Of Warranty claim form.

Complete the form as much as possible, I listed in detail here that I had proof of Nvidia admitting liability of the fault to HP. I referenced various websites here also to back this up.

Have a IT Engineers report completed on the laptop, this only cost £20

Send the all the above with receipts or bank statement in my mams case together with a covering letter giving further details of the inherent fault

The cheque for £379 was received by my mam a few days ago from Tesco :D

I was only expecting £250 at best.

This was after any amount of people (mainly in know it all Computer Shops) saying that I was wasting my time.
