Hi. First off, thanks for taking your own personal time to create and maintain this website. It was invaluable for finding out what went wrong with my laptop, and avoiding the trap of sending it to HP to have it repaired with more defective parts.

Long story short, my laptop is out of warrenty, and HP is refusing to do anything for me, or even admit that the laptop is defective (symptom is black screen, and I have an 8400GS from over 2 years ago). I want to pursue the next step and take action against them, but since you guys are based out of the UK, I wanted to make sure that the legal processes are similar enough for me in the USA that I can use the steps detailed on your site, including the letter before action and engineer letter, etc. I looked around on the forums here for any information on this, but couldn't find anything, so is there any advice you can give me on this?

Hello Kika and welcome to our forum.

Well, the laws can be different from state to state so it is difficult to advise you on the course of action that you should take.

What I can say is that there have been a large number of customer who have successfully sued HP in the States so there is a very good chance that you will reach a positive resolution.

If you can let me know the model number and P/N of your laptop then I will see if I can find out any further information for you. This information can be found on the white barcode label on the underside of the laptop.

If you can let me know this I will advise further

Good news! I did a quick check on the HP Support website and found the following:- http://tinyurl.com/35yftqs

This is the BIOS update page for your model of laptop. On the 25th March 2008 HP released a BIOS update for your model of laptop. The purpose of this update, according to HP, is:-

Quote:
Updates the fan-control algorithm for the system to reduce the likelihood of future system issues.


This proves that as early as 25th March 2008 HP must have been well aware of the potential for your laptop to fal through overheating - otherwise why release a BIOS update that switches the fans on continuously to the detriment of the battery?

This is very good news for you as it means HP cannot deny that there is a problem with your laptop :D

When exactly did you purchase the laptop? If it was after the 25th March 2008 then that means that HP allowed the continued sale of a product that they recognised as one that could overheat.

Please let me know and I will advise further.
