I just wanted to check if people have had a more positive response from sending a section 75 claim to a credit card company or pursuing the retailer under SOGA ?

Quite a few people who have lodged a Section 75 claim with their credit card company have been successful.

The difficulty it seems with some of the credit card company's is getting them to understand the difference between a warranty claim and a claim under the Sale Of Goods Act.

Once you have done this it should be plain sailing.

If they play stubborn then you should tell them that you will be naming them as the 2nd defendants in your imminent small claims action.

They will not want to go to court to try and defend what is the indefensible so will probably settle without the need for litigation.

I am planning to open an account to a credit card company here in my place. This is my first time actually. Upon reading your posts, I would like to be clarified about some terminologies you have used like the SOGA and Section 75. Please do a favor in telling me all about these two.
