Hi Folks and thanks for any help.

I've got a double whammy for you.

No.1
HP DV6095EA_2C06 Atlantis 1.0 CNF6370723 repaired twice by HP in June 07 and June 08 (I have the repair summary sheets)- same fault, one long beep, 2 short beeps.
Now it has black screen and tries to start but is unable.

No.2
This was a replacement of my original HP Pavillion (bought in Staples) via a claim on my Churchill home insurance policy (new for old) as it was accidentally damaged in Sept 2006. Churchill don't have a receipt as they used a company called The Source to provide the replacement and only have The Source's invoive to them. The Source bought it from Comet, but I only know this as I have the box showing their sticker on it. Unfortunately, The Source have aparently gone bust, so I can't contact them for a copy of the receipt from Comet.

Any hope for me?

To answer your questions, here goes:-

Did you buy this from a retailer or direct from HP?

Either way this is definitely the Nvidia defect and you should seek a refund or replacement unit from the retailer.

A sales receipt is not important. What is important is proof of purchase.

You can do this by way of the documentation you have and the record of your claim via Churchills.

In law Comet cannot insist that you provide a Sales Receipt, they can only ask that you prove you purchased it.

Thanks Paul,

I'll get back to Churchill who have already offered to write a letter confirming that The Source were instructed to buy a preplacement on their behalf following my claim.
When I first spoke to Churchill's, I don't think they had reference in their invoice from The Source that the replacement came from Comet, so I suppose this is the last link to be established? I'll ask Churchill for this letter and a copy of the invoice and see if it carries a link to my laptop. The Comet box sticker cetainly shows the model and serial number.
I'll post back to update for anyone else, but I doubt if anyone could have my level of luck/bad karma! :D

Having read the posts on this site, I truly believe that the advice given will lead me to a crushing victory over Comet :twisted:

My only concern is in being able to prove that, in effect, I "purchased" the defective notebook from them, given that it was supplied to me by a now defunct company on behalf of my insurers.

Churchills are going to try to access records from their admin dept to support me, but this will take a while. I just hope they are still in existance since they date back to late 2006...

I would do, but without proof of purchase it all strikes me as a bit of a weak case. They could say that I bought the notebook secondhand or something.

With the sticker on the box, as I see it, all I've got is proof that the notebook came from Comet Group Plc and was shipped by 03/10/06 from their depot in Corby.

Don't you think I'd be better off waiting to see what Churchill can come up with to strengthen my case?

Yes, wait for Churchills.

But I am just thinking, if Churchills used The Source to supply you with a laptop and The Source went bust after buying from Comet, then surely, Churchills, who used THEIR preferred supplier, The Source, should bear some responsibility?

Because technically the contract of sale was between Comet and The Source and not you and as far as I am aware, warranties are not transferrable.

I would speak to Churchills because they could be co-respondents in your case.

I agree with this although in my opinion (although I'm not legally qualified) Churchills would be the suplier as far as you're concerned and therefore the people you would have to take to court.

It would be up to them to add Comet as a 'Third Party' (although I'm not even sure if they would be able to do this as the laptop was purchased by The Source).

If it gets to the stage where you need to issue proceedings I would seriously consider getting some legal advice as the last thing you want to do is waste money issuing against the wrong party.

Thanks very much for the info. It would be a shame if I had to take action against Churchill's as they provided great service when they replaced my original HP Pavillion notebook.

As all I have is a defective notebook with its box (and a tenuous link to Comet) and Churchills are looking to provide info on paper which I will undoubtably need whoever I go after, I think it might be best for me to see what they come up with first. If they think I'm going to implicate them instead of Comet, the info I need might not be so forthcoming?

Hopefully, their info will provide evidence that they contracted with The Source to provide me with a replacement notebook (with my model and serial nos) which was purchased from Comet in settlement of my claim relating to my home insurance policy's accidental damage clause.

I feel if I don't get these specifics, they could argue that I could have purchased my notebook from anywhere?

Let the games begin!
