I have served Play.com with a notice before action and waited 7 working days. No response.
Am going to go through the small claims application process - will refer to the guides that are posted on these forums.

They haven't replied to me either so I too am going to go ahead with a court claim.

Thanks, but have just come across a problem already.

I cannot start a small claims action on the moneyclaim.gov site as Play.com is registered to a Jersey Address,
and all addresses for small claims have to be UK addresses. It won't let me use their address to start a claim.

Does anyone know of any UK address for them?

EDIT - found it:

Sovereign House, Vision Park, Chivers Way, Histon, Cambridge CB24 9BY

Phoned the location to check and they confirmed it is correct.

Quick update.

Whilst on the phone to Play.com earlier they asked me to phone HP etc etc again. I went through the motions, got a name of the support lady at HP and phoned Play.com back. After explaining again and being on hold for a while, I was told I would get an e-mail shortly. I hang up and waited. The e-mail came through from someone higher up in the support team apologising for the hassle I've had and offered me £220 which I accepted. They also said they didn't want an engineers report!

I obviously haven't got the money yet but it's looking promising.

Try calling them back and good luck.

They may even let you keep the laptop, which should fetch reasonable money as spares on Ebay.

I spoke with people there a few more times, and eventually was offered £295, including the cost of the engineers report
- which I accepted.

Happy I don't have to go through small claims, but unfortunately Play want the laptop so I cannot sell it for spares, but they will send a courier to pick it up, so no money out of my pocket.

Thank you to Paul and everyone else here for all of their help.

I have raised this question before ..... why should they have the laptop back ?

if it is expected that the laptop should last 5 years (and even this is questionable) and then it died right on the 5 year anniversary, then YOU would have the dead laptop to sell as parts after its expected life span ,......... or even keep it as a ornament ! ;-)

The laptop has a monetary value that IMHO you are entitled to .

You therefore must decide if the fight for that is worth it .

Hello Ralph,

I totally agree with you on this point.

The trouble is, for some, the hassle of going to court just to maintain ownership of the laptop, would be a battle not worth pursuing.

What is interesting is that the way some of the retailers word the refunds that they give. Some state that the refund is in fact a "contribution towards a replacement laptop". If they state this then they do not have the right to the laptop.

If I remember correctly in order to maintain ownership of the laptop you have to claim damages rather than a refund.

If the retailer does insist that you return the laptop then I would request from them a certificate of data destruction to confirm that any data held on the hard drive will be safely and securely destroyed.

Hi,

Just to keep you in the know about how things turned out:

In the end I got a refund from play for £295 (which included £65 for the engineers report).
I also received a gift voucher from Play for £30, in respect to the time and effort wasted in going through with all of the returns procedure.
I requested a certificate of destruction for the hard drive, and am still waiting on this - otherwise will have to chase it up!

Thank you again to Paul and all of the forum members who helped me out with this case.
Your support is very much appreciated!
