Hi,

I am so happy to come across your website I could cry! Here is my story.

I purchased the laptop in Comet in November 2008 the serial number is 2CE7301G41 it has the NVidia 8400M graphics cars. After 6 months of owning the laptop, the laptop died on me. I contacted Comet and it was collected and replaced with a new hard drive. I was gutted as I had not backed up my drive!! I lost everything.

The laptop worked for another 6 months. There were several problems. It would over heat a lot. I bought a cool pad for it but this did not resolve the problem. Also, I would lose connection on my home network and would not connect again until the laptop had been switched off and left to cool. A few days after the warranty ran out I started getting blue screen and it crashed all the time. When I switched it back on it got a six way split screen and sort of like a bleeding on the screen. It would go in to safe mode and would say that there was a fatal error.

I contacted Comet who said that now out of warranty and that I needed to go to HP. HP said that I would have to pay to get it repaired. I decided to give up and put the laptop in the cupboard.

I recently started a job with the CAB. Our IT expert had a look at my laptop for me and remembered that there was an issue with HP and NVidia. He searched on the net and found this website.

I have done a lot of reading on the issue, so have decided that today is day one of my fight!!! I am going up to Comet armed with the information that you have given me. I am so glad and grateful that people make the effort to create forums such as this!

Hello and welcome to our forum.

Sorry to hear of the problems you have been experiencing with your laptop but glad you have found us.

That is a typical fob off from the kings of fob-off's and is absolute baloney!

Comet are liable to you for six years from the purchase date when the goods in question are inherently defective. They cannot simply state that you are out of warranty when they must know for a fact that these laptops are inherently defective. Furthermore it is always Comet that is responsible to you and not HP so you should tell them to stop giving you false information.

You are in an excellent position working for the CAB as you will no doubt get all the legal advice that is available.

The key to success with Comet though is persistence, persistence, persistence.

If your laptop is indeed inherently defective then you really cannot lose.

I have had a call from the store this morning. The lady said that my laptop is not one of the laptops with the NVidia problem. She has spoken to head office and to HP. So they will be unable to help.

I have now written a 'letter before action' from your template on the website and will send recorded delivery.

<rant>That is one of the things that really winds me up about the retailers :x

They know that the list of affected laptops isn't complete yet they persist in attempting to fob off their customers in the hope that they'll give up and go away. :x :x

Your laptop has one of the GPU's which is most well known for the defect. They know that despite what their scripts tell them to say.

Whatever happened to Customer Service??

At the end of the day it doesn't matter if the laptop is on HP's list, Comet's list or anyone else's list - if it's got the defect then it was inherently faulty when you bought it and therefore you have rights under the Sale of Goods Act FULL STOP :x :x :x

I fully agree with Ciderboy's reply. How much longer are these retailers going to try and hide behind the ridiculously inadequate list that HP has failed to update for over a year?

Take no notice of them and completely disregard the woefully incorrect advice that their Customer Dis-service department told you.

Send them the letter before action and wait seven days. If you receive no reply then move on to the next stage.

Let them try and use that defence in court again because like so many times before, they can only lose!

Thank you for the support. It is great to hear what you say. Makes me feel so much better after having spent nearly £700 on a laptop and then just after a year having to buy a new one as HP and Comet were so useless and did not care about their customers. :evil: :evil: :evil:

I have today had a letter telling me that the dv2535ea is not one of the affected laptops so they have kindly offered to charge me £49.99 to have a look at my laptop!!!

I guess that I now need to get a report from Lapcure?

I don't know how they can say that when time and time again customer have been refunded against this particular model of laptop.

First of all I would reject their offer of an inspection. Why should you pay them to inspect an inherently defective laptop they sold you when it could be said that their opinion could be biased?

Furthermore, on the 8th April 2008 HP released a BIOS update for your laptop named F.2A. This update was released due to the overheating issue with your laptop and the specific reason, given by HP, was:-

Turns the system FAN on at the lowest speed, when the notebook is powered on.

This proves that as early as 8th April 2008 that HP must have been aware of the potential for the premature failure of your laptop.

Considering that your laptop contains one of the most prolific of the defective GPU's, the Nvidia 8400, then I cannot see how Comet can deny that there is a problem with your laptop.

Comet have received more than enough complaints and returns to realise that HP's claim that there is no problem with your model of laptop is just absolute baloney.

Your next step is to obtain an engineers report in order to prove that your laptop is inherently defective. For further information on this process please see here:- need-an-independant-engineers-report-t62.html

Have now had the laptop report thanks to lapcure. Very detailed and accurate.

I have now sent the report to Comet with a nice letter. Of course I can predict the response from them!!!

I guess it will be 'see you in court Comet' unless they shock me with an acceptable offer and I very much doubt that!!
