Hi All,

I purchased a HP Pavilion dv2699ea from a company called Bluepoint (http://www.bluepoint.net) sometime in December 2007.
As far as I can remember it was paid for with a company credit card.
I have had a lot of problems with the display for about a year now and the problems have got a lot worse lately to the point where the laptop will barely turn on for a couple of minutes.
I rang a local laptop repair company here in Dublin and they put me onto this website.
So after a bit of reading I sent Bluepoint customer services the following email yesterday:

Hi,

I purchased a HP Laptop from your company sometime ago (Please find the details below).

Product: HP Pavilion dv2500
s/n: 2CE74648LM
p/n: KC227EA#ABU
dv2699ea
Graphics Card: NVIDIA GeForce 8400M GS
I have had a lot of trouble with the display recently and after doing some research online I have discovered that this model laptop is inherently defective due to the Nvidia GPU (NVIDIA GeForce 8400M GS).
I believe that the original 12 month warranty is irrelevant as I have six years from the date of purchase to take action against the retailer when the goods in question are inherently defective.
Since I purchased the laptop from your company my sales contract is with you and not the manufacturer so I request either a refund or a replacement laptop to the same value.
I am not prepared to accept a repair as I believe that there are no reliable parts available at this time that can guarantee the repair will be 100% free of the Nvidia defect.
Could you get back to me as soon as possible and let me know what your position is.

They replied to me today with the following:

Hi,

Thank you for your email.

During the 30 day DOA warranty the customer must contact HP, they will issue DOA paperwork to enable the unit to be returned to Bluepoint. This paperwork must be supplied or an RMA will not be given. If the unit is outside of the 30 day DOA period HP will service the unit directly.

Hello Airways,

That is very unfortunate as it means that as the sale was a business sale then you are not protected by the Sale Of Goods Act.

I personally think it is scandalous that a consumer can purchase a laptop that is inherently defective and doomed to fail prematurely and have recourse yet a business customer can do the same and not be covered.

I would say that your only course of action would be to pursue the credit card company as they are equally liable with the retailer.

The good news is that on the 8th November 2008 HP released a BIOS update for your model of laptop and that can be found here:- http://tinyurl.com/32f4fp2

The purpose of this update, according to the HP support website is:-

Quote:
Turns the system FAN on at the lowest speed, when the notebook is powered on.


This proves that as early as 8th November 2008 that HP were aware of the potential for your laptop to overheat - hence the need to release a BIOS update to switch the fans on 24/7 to the detriment of the battery.

This information should act as part of your proof of the defect that is present in your laptop.

You could always try contacting Bluepoint and point out the BIOS update that was released for your laptop. You should further point out of the number of HP laptops that are affected either by the Nvidia defect or by their appalling design that causes them to overheat and fail. Let them think that you are going to sue them and see what they say. Don't let them fob you off by telling you to go to HP, it was Bluepoint who sold you the defective laptop so it has to be Bluepoint that resolves it.

Hello Airways,

You need to contact the card company and tell them that you want to make a Section 75 claim as the laptop you purchased with your credit card is inherently defective.

They will want some proof that your laptop is indeed inherently defective and you would provide this via an engineers report.

Once you have the report you should forward a copy to the credit card company and see what they say.
