Hello,

I have a DELL M1330 laptop that is giving a blank screen when booting to Windows, under safe mode it works fine (but then that uses CPU generated video). I have run the diagnostic tests and I get a video memory error code of 5300:0119 when the video memory test is performed.

I have well over a year of extended warranty left, and have contacted DELL about this issue. They have offered to send out an engineer to replace the part but I was arguing for a refund or replacement. I spoke to a manager who said that the issue only affected a small number of machines (implying mine wasn't one of them) and that I've had the laptop now for nearly two years so that a refund or a replacement was out of the question. I mentioned that I would be unhappy with a replacement part as the issue would happen again, maybe not immediately but most likely when it was out of warranty. I have requested to speak with the legal team about this issue, has anyone had any luck getting refunds or replacements with DELL, or is that as likely as hens having teeth?

Another issue is that I bought this laptop through my company, so it was paid for with a company credit card (VIA Delta) and also the extended warranty is a business warranty, so am I not covered by the Sale of Goods Act?

Any help or advice would be greatly appreciated.

Sorry to hear of the problems you have been experiencing with your laptop.

Firstly, Dell have admitted to a problem with your model of laptop and that is here http://tinyurl.com/36fdpk8

Unfortunately though as you purchased this as a business customer you are not covered by the Sale Of Goods Act.

You may be able to seek a resolution through the credit card company and I would say that they would be the one's to pursue if it is a refund, partial or otherwise, that you would require.

You would be advised to take some legal advice to see what form of action, if any, that you could take against Dell.

Sorry I am unable to give you more definitive advice.

Please keep us updated on your progress.

I had a call from the legal team, who like the service department, were saying that I've had the computer nearly 2 years, so why do I think I'm eligible for a refund or replacement now? I argued the toss with the guy for 30 minutes. He refused to provide me with a written guarantee to say that the issue will not happen again. He also said that, under my service agreement, DELL can continue to repair my laptop until it is no longer economically viable to do so (i.e. it is out of warranty) before they consider offering a replacement :cry:

The technical department are going to call me back tomorrow, chances are they won't be able to provide me with any more information. Has this issue actually been fixed? They're saying that the new MOBO/GPU will fix this issue for me, that DELL and NVIDIA have worked together to resolve this. Is that right? If so, when an engineer comes how do I check that the M1330 MOBO/GPU is one that has the fix, rather than an old (inherent issue) one, or heaven forbid a refurb?

The latest update is that the DELL engineer turned up and replaced the motherboard. The GPU is the newer (revised) version, I also got a new slot loading DVD drive and they fixed the webcam.

I had been quite vocal in my complaints throughout, and got a callback after the engineer had been. I've been offered a replacement laptop now, they've given me £700 credit for my 2 year old DELL M1330 with the ability to transfer my existing (2 years left) warranty to the replacement. As much as I love my M1330 I decided to accept their offer and am now awaiting delivery of an Alienware M11x. Not sure if this qualifies as any sort of success but at least I won't run the worry of my GPU overheating again.

Not sure I understand your post.

Did the engineer turn up and repair your laptop then they offered to give you a £700 credit towards a new laptop?

I wonder why they did that if they repaired your laptop?

Well at least you got a brand new laptop in place of your defective M1330 so that is a result.
