I have written to head office at PC world, taken my broken HP Pavilion laptop to the store, it's confirmed by them it has failed due to the nvidia defect. Head office have called and offered £570 + the £28 I paid for a report on the problem.

Originally my laptop cost £999 and it failed by 18 months, totally unusable. PC world tell me to do a data transfer of my files I will have to pay for that as it's my responsibilty.

The (suprisingly helpful) Tech guy at pc worlf told me it will cost £100 for copying over my files, so by the time I pay that I am left with only £498 to replace a computer that was worth £1000, personally I don't think it's a very good offer, I have told them I want to think it over, but not sure now what to do?

Hello EKW,

Well, by my calculations they should be offering you a minimum of £699 excluding the £28.

You stated that the laptop failed in November 2009, what was the date that you actually reported the problem to PC World?

It will not cost you £100 to transfer your data, it will cost you about £15 if you are prepared to do it yourself.

Do you have another PC or laptop that you could transfer the data to? If so, you should just purchase a USB caddy, remove the drive from the laptop, pop it into the caddy, plug it into the other PC/laptop and then copy the data. Its as easy as that.

Once the data has been copied you can then pop the hard drive back into the laptop and hand it over to PC World.

Doing this yourself will save you about £85 over PC World's ridiculous price.

If you let me know the date you contacted PC World with regard to the failure of your laptop then I will revise my refund calculation.

Thanks for the help! Well it failed in November 09 and I got a engineers report in December 09, I couldn't afford a repair and then earlier this year I discovered this website and started to proceed with correspondence with pc world back in june of this year. They have accepted that nvidia defect is to blame after their technical department confirmed and this Saturday I got a call from head office with the offer.
The original engineers report is dated December 2009.

Well, we will then use the December 09 as the date of failure as that is evidence your laptop had failed at that time.

Therefore the refund should be circa £683 excluding the £28 you paid.

I would therefore tell them that unless they raise their offer to the above, which is roughly what you would get if you went to court, then you will have no other option but to file a small claims action against them.

They have lost so many small claims actions recently that they may be getting the message that they simply cannot win if they go to court and all that their attempted defence will do is to increase the amount of consequential losses that they will have to refund you - which will be far greater than the £683 that they would have to pay of they settled now.

Was put on to this site by my computer repair man who says my laptop failed due to the Nvidia defect. I am about to take step 1 in the process.

How did you calculate the refund value you state above? I paid £530 for my Sony VGN-NR32S T5550 on September 2008 and it failed two weeks ago.

Sorry to hear that your laptop has failed but I am glad that you have found us so we can now help you.

In order to calculate a refund based on usage you would do the following calculation.

1) A laptop should last 5 years = 60 months
2) You paid £530 for the laptop
3) £530 / 60 = £8.33 (This is the monthly rate)
4) Your laptop lasted 23 months
5) 60 - 23 = 37 (This is the remaining months that you have not had)
6) 37 * £8.33 = £326.83

So, based on a purchase date of 1st September 2008 and a failure date of 1st August 2010 you would expect to receive £326.83 as a refund if such a refund were to be based on usage.

I have gone back to PC World to say the offer was not enough. They called today and have upped it to £630 which includes the engineers report. I personally still think this is not an acceptable amount since I have also just paid to have the data transfered.
I really don't know what to do now, should I begin court proceedings? Or write to them again to try and get them to up the offer?

I need to replace my pc like for like as I need a good computer but I won't get anything as good as the laptop I have lost for the moeny they have offered. I just want my computer back :-(

Having been to the store, where they obviously knew about the problem and put me straight on to head office, the guy at Head Office new nothing about the Nvidia Defect nor, more surprisingly, did he know anything about the Sales of Goods Act. Luckily I did, thanks to this forum, so I educated him. Am now about to write my letter before action for sending.

How incredible that their head office knew nothing about the problem. These guys must be inundated with claims so one would have thought that word "Nvidia defect" must be etched on everyone's lips.

What also amazes me is the lack of knowledge of the Sale Of Goods Act. Working in a Customer Services department one would have thought that this would be part of their basic training.

Don't forget to send your letter via recorded delivery and please remember to keep copies of the letter and postal receipt.

Hello

This is such a great site so thanks in advance for all the help and info you give :-)

I have a Sony all in one TV/PC, purchased in Jan 2008 for £1059 everything was fine until a few days ago when had a series of small and large green dots on screen. Tried to safe reboot, restore to earlier point etc but nothing. Took to local Computer Tech Company and they advised the graphics card is the problem, because sealed unit they are unable to repair. They have disconnected the file to the TV so that i can use PC part of it (Still have faint lines on screen) but no use of TV.

After finding this site i have spoken to PC World who knew all about defect and have passed my case to CCTI? they apparantly will call me in 5 working days time to discuss. Secondary to this my model is on a recall list from Sony who would have collected it and looked at it for repair free of charge, ive sinced cancelled this after looking through pages that say NO TO REPAIR!!

Will let you know how i get on
