After reading through the very helpfull infromation found on here, I too called currys today.

My call was answered by a gentlemen and I explained that I belive my computer was infected with the Nvidia GPU, he then went on to ask if I had an insurance policy on the laptop as it was purchased in febuary 2008 I said no, he then said they couldn't do anything because it was out of warranty and I should take the matter up with HP.

As advised on here, I then said that I had upto six years etc...... instantly his attitude towards me changed, he then went on to take my details inorder to recieve a call back from the out of warranty claim team, which he said would be in the next 9 days not 5 like others on here.

I do feel from his attitude change that they may have been briefed from there colleagues about other matters they might be dealing with, so fingers crossed I will get a good result from this to which I will keep you informed.

Hi Matt,

It's interesting - there have been a few reports on here that seem to indicate that DSGi are changing the way that they deal with these claims. Although they're still being a bit naughty by holding back on information until you make it clear that you're aware of their rights.

Exactly what did he mean by this? What does an insurance policy have to do with anything?

If your laptop is indeed inherently defective then it is up to the retailer to sort it out. It is not a situation where one could claim on an insurance policy. And why should you? More to the point, why should an insurance company have to pay for the inherent defect?

I would not accept their 9 day lead time and would set the timetable yourself.

I would send them the letter before action that is available here:- letter-wth-report.pdf

If you download that, edit it with your details and send it via recorded delivery to their head office.

This gives them seven days to comply. If they fail to respond in that time then you should move on to the next step.

Hello Matt,

My argument is why should you have to work to their "inconvenient" timetable?

I would send them the letter before action (without a report) to kick things off and to let them know you are serious.

You need to set the timetable, don't let them otherwise you could be waiting much longer. You should hold them to tight deadlines. I recommend seven business days from the date of each letter.

Thinking about it, I agree, why should I be governed and sat around waiting for them on there terms, after all they might not even call back.

I will send the letter first thing in the morning with the ref no they gave me today on your recommendation.

Currys called me today, they asked me if I had a report on the laptop yet, which I haven't.

They then asked me to take it into pc world to have a report done free of charge,
this has got me suspicious, is it wise taking it to them? I just dont know, would an independant report be better, would they be bias?

Are they just doing this so i dont claim the report fee back from them if I was to get an independant report

Any advice would be greatly received

Hi Matt

Your tale is very similar to mine, and I'm awaiting £600 in vouchers right now.

Briefly, mine failed after nearly 3 years on 8th August. I sent the letter before action that Paul mentions above, and I was assigned a case manager by return letter with an instruction to call them (I suspect they did try to phone me, as they stated in the return letter to me, but I don't have a phone attached to the number they'll find for me in BT's directory). I called them, and they said the same thing, telling me to take the machine to a local shop (no mention of engineers and reports) and ask the staff to phone the case manager and confirm that the machine was faulty. I did this on Tuesday (24th), and spoke to the case manager while I was in the shop who offered me £590 as a refund via bank transfer (BACS) or £600 in store vouchers (I had nearly 3 years use from a £1200 machine that's nearly 2 years out of warranty, implying that Currys thought I should have had 6 years use from the lappy). The whole call lasted no more than 5 minutes, and the case manager was knowledgeable and most grown up about the whole thing.

So, it might be that they're doing the same with you. If it were me, I'd take it to the shop. They might just start it up to confirm it's dead and make you an offer. If they do want to get their engineers to look at it you don't have to surrender the machine there and then, it's your machine and they can't tell you what to do. You can opt to get an independent report *before* handing it over to them, if that's deemed necessary in the end. Whether their report would be bias is something we can only guess at, and a moot poiint as the burden is upon you to prove that the machine is defective, so you can't do anything but get an independant report if that's where your case is heading.

Well, after six months of ownership there becomes what is known as the reverse burden of proof.

This means that it is up to you, the customer, to prove to them that your your laptop is inherently defective.

I always feel that an independent report is the best in these situations and our members successes bears testament to this.

You asked if their opinion would be biased. Well that is a matter of opinion!

What have they said they will offer once they have inspected your laptop? Have they offered a repair or are they offering a refund?
