Have you obtained an engineers report yet? If not you will need to do this prior to commencing court action.

If you have and you have provided HP with a copy then you are ok to proceed to file a small claims action and can do so at www.moneyclaim.gov.uk

Just to keep people updated, I have obtained a report from Paul, its just that I hadn't linked my user name with my name used for the report so Paul was unaware. It was after I sent this report to HP with my second letter that I got the negative response from HP. I'm not sure how my laptop can be 922 days out of warranty since that implies it never had a warranty. The interesting part being is that I paid for three years at home warranty as well (which ran out in February 2010, when I first contacted HP and before I knew of such defects)

Following advice I am now going to write a lengthy letter to my credit card company who I used to pay for the item in full and see where that takes me under S75 of the sales of goods act.

I am not overly hopeful of a positive response from the credit card company, but need to go through this step before I go down the County Court Line...

Nothing that comes out of planet HP with regard to this problem makes sense, I think they must make it up as they go along.

Don't forget that you also want the cost of the extended warranty back as they cannot charge you for a warranty on an inherently defective product.

The credit company have to try and help you so don't let them fob you off.

It's taking time, because I no longer have the credit card that I purchased the laptop on, however after writing to the company and chasing by phone they have confirmed that I did indeed purchase the laptop via them. I am just waiting to receive the copy statement.

Will keep everyone updated, I have your template letter and will be working from that..

Well the wheels do turn slowly but I appear to have finally got the result I deserved. After finally getting confirmation from the Credit Card Company that I did purchase the laptop from them, I sent an 18 page 'dossier' of my history of problems, the royal mail couldn't confirm that they had delivered the recorded delivery letter so I sent it again via Special delivery. The next day (so obviously it all crossed in the post) I received a letter offering a gesture of good will of around £550 (they clearly had used the lifespan calculation on this site) but that would be on the undertaking of making no further claims against the company. I took advice and rejected this and asked them to cover my small expenses of around £100 (Paul's report and a lot of posting of documents back and forth). I received a letter back within two weeks offering me a full refund of the full sum paid on the credit card. Clearly I will be accepting this! Will write this up in full once I have actually received the agreed funds, its been a long battle, HP have only once acknowledged my letters, but the credit card company have done everything they should have so I cannot fault them. The biggest thank you must go to all of you on this site for your advice and of course Paul.....

Well done on your success, made possible in part by your persistence.

It would have been easy to have walked away and given up, or to have accepted their offer of £550.

I do always say that if you have paid by credit card then you have a greater chance of a 100% refund and your case is another testament to this.

What a nice result for you to end the year on :! :! :! :!

With that you could afford a laptop and an unexpected winter break in the sun :D
