Hey hey,

I visited John Lewis today with my beautiful dv2799ea which sadly contains one of the defective chips. Although I was told it was out of warranty etc etc, I used the information provided here to make my case and I'm (hopefully) beginning to get somewhere. So thank you so much for all your helpful information!

I'd like to ask for some advice to help me with my second visit. My engineer's report will be done in a couple of days so I can go back armed with that (rather than let hp examine it for a fee as they offered), but do they have to send my laptop off to hp once they have the report? They have said that if it is confirmed that it contains the defective chip they can offer me a repair or partial refund. I know I don't want the repair, but am I not entitled to a full refund? Any help would be really appreciated!

Thank you so much again for all your help already, I'd still be lost and confused with a broken laptop if it wasn't for this forum!

John Lewis are entitled to examine the laptop in order to verify the contents of the report so you should let them do that.

What I would do though is to hold them to a tight timetable. I would give them seven business days to offer you a resolution and I would tell them that unless they have done so in that time then you will have no option but to file a small claims action against them.

Regarding a repair, I would advise that you reject this if they offer it to you.

Why?, Well, On the 8th April 2008 HP released an upgrade named F.2A for the BIOS contained in your laptop. One of the “fixes/enhancements” of this upgrade is, according to the HP website:-

Quote:
“Turns the system fan on at the lowest speed when the notebook is powered on”


This BIOS upgrade was released by HP in order to prolong the life of the Nvidia GPU by trying to keep it cool. Reading further into Hewlett Packard’s support section on their website it also states the following:-

Quote:
“The new BIOS release for your notebook PC is preventative in nature to reduce the likelihood of future system issues. The BIOS updates the fan control algorithm of the system, and turns the fan on at low volume while your notebook PC is operational.”

This is very relevant to your case as if they do offer a repair then the mainboard that will be used will be the same part number as the board currently in your laptop. If this is the case then that means that the replacement board will also have the BIOS update - in other words it will be potentially as inherently defective as the board it is replacing.

A replacement laptop or a refund, partial or otherwise, are really your only viable options.

Charlie,

This is great news. My case is now under review at John Lewis. I have sent them the first letter and they are investigating the matter. I ahve sent them other evidences and images of my laptop,
If you don't mind could you please share what else you did to make the process faster? And which John Lewis shop was it? Did you take it ot the shop or with their head office?

I could perhaps use your name as a reference for such a case if it is not a problem for you.
