Hi there,

I purchased an acer aspire 5920g from comet around january 2008 and have recently been unfortunately afflicted with the nvidea defect unfortunately however comet have been insitent that I take it to thier engineers for a charged inspection I have informed them that I will obtain an independent engineers report and send them a copy and they accept that they will be happy to investigate the matter further if I do as such.

Just looking for any particular pointers anyone has about the best way to approach comet and any other steps you think important.

Hi there eremenko.

The important thing with Comet is not to let them grind you down - they haven't earnt their award for being the worst retailer to deal with for nothing :(

The odds are that you'll have to go all the way through court proceedings before they settle just before the hearing. Just remember, if it is the defect you're suffering from, then the law is on your side.

Hello Eremenko and welcome to our forum.

Sorry to hear of the problems you are experiencing with your laptop.

You did right to refuse to allow Comets "engineers" to look at your laptop. It is down to you to prove to them that your laptop is inherently defective and in my opinion any inspection that they may do could potentially be biased.

There is a step by step guide available on this forum that will help you reach a positive resolution and that is here:- post13.html#p13

If you follow my advice in that guide then you will reach a positive resolution.

This is the wierdest part of my correspondance so far

"the Sale of Goods Act 1979 (as amended) requires the purchaser to prove that the fault was present from the date of purchase. In the circumstances, we are unable you meet your request for a free repair or replacement.

Therefore, Comet’s request for one of our engineers to inspect it before we decide how best to proceed is reasonable and not in contravention of your consumer rights."

And this came after I had already mentioned the inherent Nvidea defect.
Basically they are saying "its up to you to prove its faulty so send it to us so you can't" obviously I dont hold the guy writing it responsible hes just copying from a script he was given.

Hello Eremenko

To be honest Comet may not accept the report for a number of reasons.

They have stated that purely because there was no display to the LCD then it must be the GPU, though they haven't provided any evidence to substantiate that statement.

I say that because the fault could be caused by a failed memory stick or a failed CPU. They haven't performed any tests which proves that your laptop is inherently defective.

In fact, they state ".......leading us to suspect an inherent manufacturing fault"

I don't think that their suspicion will be enough to convince Comet.

I could be wrong of course and they could accept the report, though I know of plenty of reports from other companies that have been rejected.

Ok thanks Ill wait and see what comet say and if necessary Ill acquire another report, at the moment they are claiming that I have not attached anything to my email which if you ask me is on par with the excuse "the dog ate my homework" they seem to enjoy stalling.

Hi again

I just received a response from comet stating the following "Please return your laptop to your nearest Comet store for a free of charge inspection to be booked. Once inspected, our Computing Support team will be able to advise further." I am planning on telling them no on the grounds that I do not believe they will provide an honest diagnosis. I was just wondering if there was anything anyone had to add?

I would add that due to the reverse burden of proof that the onus is on you to prove to them that your laptop is inherently defective and it is not for them to prove this fact to you as their opinion could be biased.

That is all you really need to say.

Thanks Paul I did as you said and comet have come back to me with the following,

"Whilst I note your comments, and apprehension, about Comet making an honest assessment of the fault to your laptop, I would have to advise that if you chose to seek an engineers report from a third party, Comet would not cover any costs incurred by this. Comet would also still ask to inspect the laptop to verify any findings that may be made. It is with this in mind that a free of charge inspection by Comet is being offered. It would not be in Comet's, or your, interests for any bias in diagnosis as Comet would always wish to be an amicable party in such matters. I would, therefore, reiterate the previous offer in the hope that we can work together to resolve any problems."

what do you think? if I get a full engineer's report stating that it is inherently defective will they still need to inspect it or are they just attempting to stall me?
