Thanks very much for taking my call this afternoon to get the ball rolling on my case. For all others viweing. I bought an HP COMPAQ 6735s laptop from ebuyer in Feb 2009 and it died June 2010. With no help from ebuyer or HP. Just to let you Paul I called ebuyer one last time and they said again to phone HP, I said that I wouldn't and that I would be in contact by letter demanding a replacement. I have just whisked the letter off and should hopefully here something in the coming days. I'll keep you posted.

Hello Wills and welcome to our forum.

Your laptop will not have the Nvidia defect as it contains an ATI GPU rather than an Nvidia GPU.

However, this does not mean that you will not be able to receive a free repair.

In your case a repair would not be out of the question as there should be no problems with replacement parts so you probably will not be able to secure a refund or replacement laptop.

When I speak of how long a laptop should last I state a period of five years. That does not mean that a laptop will not fail within that time, that can happen and is, unfortunately, acceptable. However, where a product fails catastrophically so soon out of warranty then that is a different matter.

The courts would agree that the main part of a laptop, the motherboard, should not fail catastrophically within sixteen months of light use.

Let us see what Ebuyer has to say.

Thank you for contacting Ebuyer Complaints Department

I’m writing today further to your email of complaint, which has been passed to me to be addressed. First of all, please allow me to offer my most sincere apologies for all of the inconvenience that you have experienced. I can assure you that this is not indicative of the usual high level of service offered by Ebuyer.

On viewing your order I can confirm that Ebuyer UK Ltd holds 12 months warranty for your item, any further warranty is held with the manufacturer. However I can also confirm that as per the Sales of Goods Act 1979 (as amended) you are able to have the item repaired or replaced up to 6 years. This only applies if you are able to provide proof that the item was purchased with an inherent fault or that the fault occurred is due to a manufacturing defect. The proof must be in the form of a technicians report carried out by a qualified computer technician whom works at a registered company. Only if this is proven to be an inherent fault or manufacturers defect will Ebuyer reimburse you up to £30 towards the cost of the report.

Please note that all technicians reports are subject to the relevant checks.

Without the technicians report or if the technicians report is received and does not prove this to be an inherent fault or manufacturing defect Ebuyer hold no legal obligations to accept this item back.

If this can be provided please forward this on marked for the attention of myself and I will be more than happy to readdress this for you.

I once again would like to offer my sincere apologies on Ebuyers behalf for any distress that may have been caused. If you have any further queries or concerns please do not hesitate to contact me.

Well, it looks like they are taking your claim seriously and so the next step is the engineers report.

We can help you with that.

We have had numerous successes against Ebuyer and most of the high street retailers when they have been presented with a copy of our report.

In order to proceed please take a look at the following:- need-an-independant-engineers-report-t62.html

They stated in their letter:-

Quote:
Only if this is proven to be an inherent fault or manufacturers defect will Ebuyer reimburse you up to £30 towards the cost of the report.


They cannot set this limit as the cost of the report is a consequential loss and they have to refund it in full. Just like all the other retailers have done on numerous occasions.

Hi Paul

You should hopefully have the laptop with you today. I packaged in with my old laptop bag to make the box nice an secure. I thought I should mention (in case it helps with the problem) that the laptop almost from day one got very hot in the bottom left corner, to the point where it had to sit on a table like a desktop as it quite literally could scald my leg through my clothing. (the "2" key came off after around ten days also but still works)

hi all
i got the same problem as you Will. my laptop hp compaq 6735s keeps overheating(i cud boil an egg on it) i bought it at ebuyer aswell but in march 2009. how wud i go about sorting this out? do i have to call them up first threaten them for a refund/repair? or write to them explaining what is happening.

excuse my english but i have learning difficulties.

Hello Knguyen and welcome to our forum.

Sorry to hear of the problems you have been experiencing with your laptop.

I would contact Ebuyer and tell them that you believe that your laptop has a manufacturing defect and that you want either a refund or a replacement laptop.

They may tell you that you are out of warranty. You should tell them that you have six years to take action in such situations and that the warranty status is irrelevant.

They may also tell you to contact HP. You should tell them that your contract is with Ebuyer and not HP and it is for Ebuyer to resolve the situation.

How did you pay for the laptop? If you paid by credit card then you would have extra protection as the card company are as liable as the retailer for the failure of your laptop.
