Just wanted you all to know we have had yet another success against Comet.

A poster both on this site and www.hplies.com has had a real triumph against one of the big boys.

After much hassle and a bit of a battle this lady secured a brand new Sony Vaio NS30 Laptop along with £150 in gift vouchers.

How good is that!!

So, if there is anyone who needs convincing not to give up their fight then this is surely it.

If you persist and lay down the law then there is no way you can loose - at least in the UK anyway.

If anyone needs help or advice then please let me know or visit www.nvidiadefect.com - you can even download a template "Letter Before Action" to send off to the retailer.

All our help and advice is free. The only thing that we charge for is the Engineers report and the best bit about that is that the retailer has to pay for the report.

Just after i had spent the morning putting my arguments together for the big day, i checked my email

Dear Mr x

Due to unforeseen circumstances it will not be possible for us to attend the hearing of 21 October 2009. In view of this arrangements are now in hand to forward you a cheque for £1110.96 in full and final settlement of your claim. In view of this I would appreciate it if you would now contact the Court and withdraw this claim.

If you have any queries regarding this please do not hesitate to contact me on 01482 592442.

Now, the big question is, what are you going to spend all the cash on?

hello, well i will prob need a quote for a reflow to get the thing saleable ;)
I will Definately never buy anything nvidia again, as i purchased a dell studio with ATI :lol: just after they dumped out nvidia and its plenty good enough for what i need.

Great news which gives me a bit more hope. However, I wouldn't withdraw the claim until you have received the cheque from them.

I would contact Comet indicating that you would not object to them lodging a consent order with the court to 'adjourn the case to the first open date after 14 days'.

This will protect your position and hopefully speed up the production of the cheque. It will also have the added bonus of causing them a bit more grief/expense :D

Too late im afraid as we faxed the court yesterday, im sure they will not pull a stunt like that with my money, I won't stop my fight until the cheque has cleared, but good advice for anyone else in the same situation.
