Hi paul, sorry for the delay ive been camping with my missis, a nice cheap and cheerful holiday (has to be.....considering baby is on the way :D)
and i came back to find a reply from sony coventry (aka william robb ltd) this is the letter i received.......

Dear ....

please be advised that we have taken the opportunity to clarify whether your model is part
of the sony free of charge repair scheme in connection with the nvidia graphics card
issue.

we have been informed that your model is in fact included in this scheme, we have therefore been asked to advise you that in order to have this issue resolved that you contact sony vaio link on 08702 402408, where they will arrange for a free of charge repair on provision that the fault described is proven to be under the Nvidia issue.

should you have any further queries regarding this matter, please do not hesitate to contact us at the coventry store on 02476 559111


Are they Just fobbing me off, what would you recommend i do now?
i'm willing to stick it out, but dont want to shoot myself in the foot, i'd much rather get the replacement or refund.

I am off camping on Sunday for a week with the wife and missus as well. Cannot take more than a weeks holiday though as far, far too busy at work. It's a good job I won't be able to get a Wi-Fi signal as I would be tempted to work. :D

If you are happy to accept a repair from Sony then great, give them a call and take them up on their offer.

If however you have no confidence in the repair that will be undertaken then I suggest you get in touch with them and ask them for a written guarantee that the mainboard that will be used will be free from the defect.

The guarantee should be as follows verbatim:-

"The mainboard being used to repair your laptop is from a completely new batch and is 100% free from the Nvidia defect. If, at any point in the future it transpires that the mainboard is indeed inherently faulty due to the Nvidia GPU then a refund or replacement will be offered."

You should also ask them for the part number of the mainboard that they intend to use.

We can then check the status of that board.

If they refuse to give you either of the above then I would tell them that they leave you with no option but to file a small claims action against them.

Give it a go and see what they say and then pop back here and let me know.

If you have any questions in the meantime or if you need any advice then please let me know.

Hi Paul, how did your camping trip go? sorry i havent responded in a while, my girlfriend fell down the stairs and broke her arm (thanks fully baby is ok) , its been a nightmare, ive been so busy and been meaning to get on here and ask for more of your words of wisdom...

I Had my VAIO repaired previously with sony pretty much 6 or so weeks after purchase for some reason the hdd died or something which corrupted the whole computer and i had to send off for repair, so i have no confidence whatsoever in their repair offer, but how do i decline a repair without looking unreasonable to their suggestions, im fed up with sony and would prefer to get a refund whether through court or their settlement, or if push come to shove a current model vaio of equal or near value.

what would you suggest to be the best way of expressing this?

Hello Steph,

Sorry to hear about your girlfriend, hope she is feeling better and praise the lord that the baby is ok!

You need to contact Sony prior to sending them your laptop and ask them for a written warranty, on Sony headed paper, that states the following verbatim:-

Quote:
The mainboard being used to repair your laptop is from a completely new batch and is completely free of the Nvidia defect. If, at any point in the future, it transpires that the mainboard is inherently defective due to the Nvidia GPU then a refund or replacement laptop will be offered


The guarantee should be written exactly as above. Once you have that you should then request the part number of the mainboard that will be used.

We need this in order to verify that the mainboard is indeed from a new batch and that it is not simply a board that was manufactured using the same parts.

If they refuse either of the two then you can quite rightly refuse their offer of a repair.

If they do offer the guarantee and if they provide you with the part number then please let me know the details and I will check to confirm for you.

A judge recently stated that DSG Retail had acted "recklessly" for offering a repair "with unreasonable strings attached". DSG Retail had refused to offer the written guarantee and the customer had quite rightly refused their offer of a repair.

Try the above and see what they say and then pop back here and let me know.

Dear Sir/Madam

I write to inform you that I have received your letter and have given myself time to seek advice in regards to your offer off a free repair, due to the advice I was given and the many sources of information I discovered, it would seem the repair is only a temporary fix due to the materials and parts which are used, in order for me to now accept such a repair I ask of you to provide me with both a part number of the part(s) being used and also a written guarantee on your company letter headed paper which states the following;

If you do not respond in the positive in writing within seven working days then I will have no alternative, but to obtain an engineers report, the costs of which will be claimed from yourselves.
I will then use that report, along with the myriad articles of information that are
available to pursue this matter through the legal system.

I have amended your letter slightly and have copied it below.

If you just copy this into a word processor, sign it and then send it via recorded delivery to the retailer.

Quote:
Dear Sir/Madam

Ref:- (Enter either claim reference number or your laptop model and serial number)

I write with reference to my above quoted inherently defective laptop and to your recent offer of a repair.

Having had the opportunity to now seek further advice I am reliably informed that all motherboards currently available still could contain an inherently defective Nvidia GPU.

In order for me to consider accepting such a repair I request that you provide me with both the part number of the part(s) being used and also a written guarantee on your company letter headed paper which states the following:

“The mainboard being used to repair your laptop is from a completely new batch and is completely free of the Nvidia defect.
