I have most of the symptoms of the Nvidia defect, however trawling the net I see that some of the dv2000 series of Notebooks is included in HP's website as having Extended Warranties etc, however cannot find specific references to the dv2036ea.

I have contacted Staples who require a engineers report to replace the Notebook.

If I sent my Serial and Part Numbers would someone be able to verifiy what chip I have and whether it is defective, before sending my Notebook off for an indepentant report costing £65 (Just as money is tight at the moment)?

Regards,
Danny

The report needs to have a full header showing the company name, telephone number and vat number, or must be traceable on companies house and available for us to contact with any queries. It also needs to display the make, model and serial number of the unit concerned.

There should be a full diagnostic - details on what is wrong. Why and how they have reached that conclusion and what recommendations they make. We need a clear distinction that they consider this to be an inherent fault or not and some evidence to support this. It is also important to note that we will need to see some form of proof of purchase, whether this is a receipt, card statement, bank statement or a rewards card statement.

Just received a nice email from Paul confirming my suspicions, the dv2036ea does have an affected GPU.

Right, Staples are insisting on me having a receipt (which is understandable). With the house move, etc over the last 3 years, I have somehow misplaced it.

It is my understanding that according to the Sale of Goods Act, a receipt does NOT have to be provided for faulty goods, and that other suitable proof of purchase is sufficient, ie bank statement. Considering I bought this Notebook with cash whilst on a shopping trip with a group of friends, would their word of mouth be a suitable proof of purchase in a Court of Law, or alternatively, could I ask Staples to provide me with a copy of our Agreement (a duplicate receipt)? They are saying that they do not log serial numbers in their system so would be unable to provide me with a copy...

I done some research and come to the conclusion that they are purporting to exclude their liability and that insisting on me having a receipt would be void and unenforceable under the Unfair Contracts Terms Act 1977 and The Supply of Goods and Services Act 1994.

Does anyone have any knowledge of this to confirm, or be able to offer any guidance?

Danny,

This could get awkward. It is unlikely that a court would accept the word of your friends as they could be looked upon as being biased.

You are correct in that they can't insist on you showing a receipt. You do however have to give documentary proof that you purchased the laptop frm them.

It is possible that the store you bought it from may be able to provide you with a copy receipt providing you can give them the exact date and a rough time when you bought it.

Do you still have the warranty form that you will have filled in when you first purchased the laptop ? if so that may help in proving where it was purchased from.

I cannot find the receipt. Staples are saying that they will not pursue my claim.

Is there anything else I can do?

Hello Danny2324,

It is a very unfortunate position that you are in.

Do you know the exact date that you purchased the laptop?

If you do then you can ask Staples to search their records for the transaction.

Although if I had to be honest it is a tricky position insofar as if you cannot prove purchase then you will not be able to pursue your claim.

Ciderboy was quite right when he stated that a court could rule that your friend was biased an so may not accept their word.

I think your best option is to see if you can convince Staples to provide you with a copy receipt.

Fingers crossed for you.

Good luck and best wishes

Paul

I have found my receipt.

I took out a finance plan, buy now pay later etc, first and last one I ever did... over 3 years... so the notebook, when I have finished paying is actually double the price!!

Would I sucessfully get payments back for the time I have been unable to use the notebook?
