Today a judge ruled that DSG Retail had "Acted recklessley with offering a repair with unresonable strings attached" and that the customer had acted reasonably in refusing to accept the repair.
What a breath of fresh air this ruling is!
Whilst the results of a small claims action does not set a precedent for future cases what it does do is to enforce all that I have said about the repairs that are being offered.
The judge was quite correct to state that DSG Retail had acted recklessly and I would say that this was true of some of the other retailers offering these same repairs.
What was also interesting was that the judge ruled that he was awarding damages rather than a refund. Because of this the customer was allowed to keep the laptop - which will fetch a reasonable price on Ebay.
If this is the case it would be worth your while if you are progressing to court to request that the judge also classify the repayment as damages - that way you will greatly increase your payout by selling off the old laptop.
For all those who are facing having to take legal action against any of the retailers, or manufacturers remember the key to success is persistence, persistence, persistence.
If your laptop is indeed inherently defective then you really cannot lose.
