Received Laptop today along with your detailed report & supplement, Thank You. The laptop didnt survive very long as you would expect, i updated from microsoft and updated a couple of drivers then after about 40 minutes it decided to go Belly Up.

Anyway, I finally received a reply from Tesco today which only took them 4 bloody weeks from me sending them my Letter Before Action. Please read and comment if you would please. THEY JUST DONT GET IT DO THEY?

The Letter with Report along with supplement will be in the post tomorrow.

Hello Steve,

No, they don't get it - which is either through ignorance or it is a tactic on their part.

Please don't forget to send the documentation via recorded delivery and keep a copy of the postal receipt.

If they don't comply after receipt of the documentation then I would pop on over to www.moneyclaim.gov.uk and file a small claims action against them.

I know their slogan is every little helps, but their offer to you was way too little.

I did a little calculation to see what would be the minimum that the courts would award you should the refund be reduced according to usage.

1) You paid £650 for the laptop
2) A laptop should last 5 years (60 months)
3) £650 / 60 months = £10.83 (monthly rate)
4) The laptop lasted you 18 months
5) 60 - 18 = 42 remaining months usage
6) £10.83 * 42 = £455

I calculate that the court would allow you £455 if the refund were to be reduced based on usage.

This is almost double the miserly amount they offered you.

I would put this to Tesco and tell them that it is going to cost the much more if it proceeds to court and that they should save themselves some money by settling now.

If they refuse and stubbornly stick to their script, then you should waste no more time and should sue them.

The evidence speaks for itself and their position is indefensible.

Well done, don't be put off just because of the size of the company. At the end of the day even if they do turn up at court they really cannot win so you have absolutely nothing to fear.

I think that their attitude and handling of this matter has been atrocious and I hope that more people who are in your position with Tesco find the same courage to file an action against them.

Hi Paul,
Received defence papers from Tesco solicitor. Just a quick one Paul or ciderboy,I notice on the defence papers it says Northhampton County Court,would I have to attend there or would it be where I live? Also anyhelp would be much appreciated regarding literature I would need to gather for my claim. Please take a look at the defence papers and comment if you wouldnt mind.

Steve,

The case will automatically be transferred to your local County Court as soon as they receive the defence at Northampton - expect to hear from your local court in the next few weeks.

Their defence is the normal rubbish - absolutely nothing to worry about.

I particularly like the bit about the laptop depreciating quicker during the early years of it's lifespan :lol: According to them it loses nearly two thirds of it's value in the first 18 months of its life :@

Nice to see they actually got a solicitor to deal with it though rather than the normal work experience bod :@

I find it particularly interesting that they don't mention the Sale of Good Act at all (unless I missed it whilst scrolling around the page) :D

Make sure you mention that in the "other information" part of the AQ once your local court has sent it to you.
