Like Ciderboy says, we can provide you with an engineers report for £65 which will, if your PC is indeed inherently defective, ensure that you are successful if you were to proceed to court.

The cost of the report and the cost of taking HP to court can all be recovered as part of your claim and HP have to refund this to you.

Apart from the stress factor it really will cost you nothing.

I agree with you about how scandalous it is that this problem has been hush hushed and every attempt to show that laptops or PC's are inherently defective are met with either scorn, ridicule or outright denial.

The facts are there for everyone to see. They even released BIOS updates to try to keep the GPU's cool yet still they deny that the problem exists in laptops that are not on their "list"

Their "list" is so inadequate as to render it useless!

There are so many laptops and desktops that are failing that are not on their "list" yet they claim it is coincidental that they have failed in exactly the same way, with exactly the same manifestations. What utter baloney!

We are at the tip of a very big iceberg and as time passes we will see more and more laptops fail as the time to manifestation is dependant on whether the customer is a light or heavy user.

Regarding your case though, you have every right to proceed to litigation if HP do not give you what you want once you have proved the defect exists.

Hi thanks for your replies (much appreciated)
I'm still in the process of deciding what I should do but now only have a couple of days left because PC World customer service warned me of a 21 day deadline to make my decision otherwise my claim will be closed. In fact I feel another complaint coming on as I don’t like the idea of been bullied into making brash decisions.

However what I would love to find out right now is a list of all the known computers i.e. HP TOUCHSMART IQ790.uk and all the computers that have died due to the known Nvidia 7600 and Nvidia Defects overheating and causing a Motherboard failure.

This is because everything I have read about the Nvidia Defect only ever mentions those with Notebooks, Pavilion or other laptops……. I just know this will be the next thing out or their mouths…Oh No this only affects blar blar blar blar blar blar…….

Hello again - Update -

My offer has now been increased by another £10.00 to £450.00 and said I can keep the computer which might be able to sell for spares.

My next question is ......If I accept PC World offer of £450.00….. Can I still take HP to court? it’s just something the man from PC World said that got me thinking!!!!!

After all it’s HP the Manufacturer that I’m most angry with in shirking all responsibility and treating their customers this way whilst denying all knowledge this would be justice for the smug attitudes shown by Beryl Naidoo and all the other Case Managers who have shown nothing but contempt for their helpless customers out there whilst they still continue to take their money.

Unfortunately not, if you did and HP or the judge were to discover that you'd already been paid out on this cause of action then it could be considered an abuse of process & it's likely that you'd find yourself liable for costs.

At the end of the day you've got a fair offer there & will be able to make some more money by selling the laptop :D

I agree with Ciderboy. If you did file an action against HP the judge could rule that you had abused process.

It is a shame that you can't but then c'est la vie!

I would be happy with what you have managed to recover and leave it at that.

You wouldn't want to end up being out of pocket now would you?

I can fully appreciate your angst. There are many thousands of customers who must feel the same as you.

I do feel that HP should be investigated though on a charge of fraud by misrepresentation as they sure have misrepresented virtually all the facts surrounding which laptops are and which laptops are not affected by this problem.

HP still continue to offer, either as a free repair or as a paid for repair, boards that have had the BIOS's tweaked to switch the fans on 24/7 and claim that they are now fixed.

If that is not misrepresentation I don't know what is.

Excellent advice

Thank you so much, Paul and Ciderboy that has made things so much clearer now. I agree £450.00 is not a bad offer considering I thought I had fallen at the first hurdle without an Extended Warranty.

Sorry I wasn’t thinking very clearly when I said about taking HP to court, I got so caught up in wanting HP to pay for what they have done and PC World allowing them to get away it by selling faulty goods on shelves.

I just hope that if enough people make enough noise then maybe PC World, Curry’s, Comet etc. will stop selling their products especially when we remind them that we have rights such as the Sale of Goods Act 1979 and that it doesn’t matter whether we have an Extended Warranty or not We are not going away.

I hope HP and Nvidia get what’s coming to them and what they deserve but again shame on PC World if they keep allowing them to get away with it they only have themselves to blame.

I will be watching HP very closely.
