Hi all

Firstly, thanks for all your advice and assistance through this forum.

I have a HP G6000 purchased from Comet in Nov 2007. The wireless adaptor stopped working around Dec 2009, but as I was not using regularly then and thought it just needed a new card, I did not get around to taking it to my local laptop shop until this week.

They advised me of this issue and directed me to this website. They also installed a programme to monitor GPU and Core temperatures ..... operating at around 76 and 56 degrees C!! All apparently linked to the Nvidia issue.

Anyway, to let you know, I have today sent a letter (after being directed to do so by Comet's helpline) to Comet's Customer Services in Hull. I utilised the template letter, but added the following to try and progress matters:

For clarity and to avoid unnecessary protracted correspondence on this matter, I set out the clear facts to be considered in this case:

- The laptop had an inherent defect at the time of purchase due to a faulty Nvidia chip, which ultimately causes the laptop to fail prematurely
- My Contract is with Comet Plc, not HP
- Comet Plc are in breach of this Contract under the Sale of Goods Act and my Statutory Rights
- I have 6 years to make a claim in the case of an inherent defect
- It is irrelevant that the laptop is out of warranty
- The HP list of defective machines is not conclusive
- Comet Plc have already agreed to replacement or refund in similar cases, which are fully documented
- There is no need for an inspection to be carried out by Comet Plc (or indeed charge me for this service)
- This inherent defect cannot be repaired


Will let you know of the response I receive. Having read the background on this forum, I am willing to take this all the way!

I will not let this go now I am aware of the facts/issues. I took a car garage to court for not paying for repairs needed after a month or so of purchase (items not covered by the warranty) a few years ago ..... a year later I won! So Comet ..... bring it on!

As an update, received a call from Hull yesterday asking for the 'serial' number. Let's see what they say. If they refuse to replace, I will simply file the case through Small Claims.

Will keep you all informed.

When you think about the facts, this is very poor handling by manufacturers and retailers.....

I couldn't agree with you more.

In fact, one has to decide whether this is just ineptitude on the part of the retailers and manufacturers or is this mealy a smoke screen to try and dissuade customers from taking action.

Whichever it is it most certainly is the height of unprofessionalism.

I have received a response from Comet - not satisfactory!

In a nutshell, they say that my G6000 is one listed by HP and this has been varified by the their Engineers.

I was going to write back and provide one last oipportunity (referring to the G6000 motherboard being the same as others listed) - is this worthwhile?

Or, should I get an Engineer's report (given the facts, is this needed?) and issue with letter to Comet;

Or, (agian, based on the clear facts and presidence which now exists) proceed straight to Small Claims?

Advice would be appreciated.

So Comet have admitted that your laptop is inherently defective - what have they proposed to do?

Have they made any offer to you at this stage?

Hello Mel,

You will need to send them a letter before action before you start the ball rolling.

A template is available here:- letterbeforeaction.pdf

You should download that, edit it with your details and send it to the retailers head office via recorded delivery.

Please ensure that you keep a copy of the letter and the postal receipt.

This gives them seven days to respond in the positive to resolve the situation.

If they fail to respond then you will need to obtain an engineers report in order to be able to prove that your laptop is inherently defective.

We can help you with that so please let me know when you get to this stage.

If you look at my signature at the foot of this post you will see a link to a step by step guide. If you take a look at that and follow my advice then you will reach a positive resolution.

No, I think you would be wasting your time. It is now time to move onto the next stage, which is the engineers report.

It doesn't look like you are going to get a positive resolution without it.

Furthermore, if you are to proceed to the small claims court then you would need this to be able to prove your case.

The cost of the engineers report is fully recoverable from Comet.

For further details on how to obtain an engineers report please take a look at the following:- need-an-independant-engineers-report-t62.html

Once you have the report then you should send Comet a copy along with a final letter before action. This gives them seven days to offer you a positive resolution. If they fail to do so then you should pop on over to www.moneyclaim.gov.uk and file a small claims action against them.

If your laptop is indeed inherently defective then you really cannot lose.
