My son bought a HP TX2050EA from John Lewis in Glasgow on 18th March 2008 and it stopped working on the 1st June 2010. His screen is blank and the hard drive is not spinning. The graphics card is a Geforce Go 6150. As it was at exam time he didnt have time to deal with it so I had a look on google and found your site.

Do you think he may be able to get a refund or replacement?

He phoned John Lewis today and was told that they could send it send it away to HP as a gesture of goodwill. If HP say it's a known fault, they can fix it for him, but otherwise any costs would fall to him.

An added problem is that he is studying in California this year and wont be home till the beginning of August which is 6 weeks away.

I have offered to send the initial letter to John Lewis head office but if they ask for the engineers report it would be 7 weeks till I could send it to you for testing.

He bought the laptop with Visa electron and a £50 gift voucher.

Hello and welcome to our forum.

Sorry to hear of the problem your son is experiencing with his laptop.

Take no notice of John Lewis regarding sending your laptop away. The law states that after six months of ownership the onus passes to you, the customer, to prove the inherent defectiveness of your laptop. This is called the "reverse burden of proof".

You will need to obtain an engineers report and then invite John Lewis to inspect your laptop. Once you have given them the report I would then give them seven days to respond in the positive.

If they fail to do so then I would simply pop on over to www.moneyclaim.gov.uk and file a small claims action against them.

If your laptop is inherently defective then you really cannot lose.

It is no problem that you will not be able to obtain a report for seven weeks, I would inform John Lewis of this fact and would tell them that your claim starts from the date of your initial communication.

Otherwise you could lose seven weeks from a refund based on usage.
