Although my model was not on the HP Extended Warranty scheme & although I updated my bios to the latest version to keep the fan running, my laptop finally died with 6 images showing corrupted data a few days ago!!

The laptop runs a Nvidia 8400M GS GPU & has nearly always run quite hot, though as my first laptop I have no previous experience of what temp was acceptable.

The details are:-
Laptop Model: HP DV2535EA / Part No. GJ032EA#ABU / Serial No. 2CE7301G3J
Store Purchased: HP Direct Online
Date of Purchase: 22nd Nov 2007
Price Paid: £521
Date Failed: 10th May 2010

Looking at previous posts, I should be able to win my case.

Following the advice here, I tried to get through to HP Customer Services, but every number/option I tried led nowhere, so I've not talked to them & just sent the Letter before Action by recorded delivery on Monday afternoon giving 7 days to respond to HP Complaints at Ashby-de-la-Zouch.

I'd appreciate any advice, particularly for my model, of how to win the case.

Hello Northender and welcome to our forum.

Sorry to hear of the problems you are experiencing with your laptop.

Your model, the DV2535EA, seems to be one of the models that the retailers are refunding or replacing without much of a fuss.

The fact that HP released a BIOS update for your laptop that switched the fans on permanently shows that HP admit to there being a defect in your laptop.

I would give them seven days to reply to your original communication. If they fail to reply in that time then you should proceed with an engineers report.

Please let me know when you get to that stage as this is a service we provide.

Once you have the report you should send them a copy along with a final letter before action.

If, after seven days, they have failed to respond, then you should pop on over to www.moneyclaim.gov.uk and file a small claims action against them.

If your laptop is indeed inherently ddefective then you really cannot lose.

If you have any questions then please let me know.

Well, seven days have now passed & no word from HP, so on to the next stage of sending my laptop off to Lapcure for an engineers report.

Got my report back from Paul at Lapcure & sure enough the Nvidia GPU is at fault.
Interesting that the idle temperature was 70 degC & got up to "a dangerous 95 degC" whilst playing a DVD at which point the test was terminated.

The report has now gone off to HP Complaints last Friday with a 7 day Letter Before Action, so let's see if they now choose to contact me, or ignore it again like my previous letter.

Can see a court case being filed if other people's experience is replicated.

Would you have the adress you sent the letter before action to? I called hp twice but they directed me to look for the adress on the website... I was previously suggested by Lapcure to call them up and ask for the but the hp customer service doesnt seem to know them.
If you could put the adress you sent the letetr before action to in this post or pm me then I would thankful.

Letter before action with engineers report is now overdue after giving HP Direct 7 days to reply, so off we go to the small claims process, and more expense I now expect HP to pay up for!!

How arrogant not to reply to a customer in any way (have identified my home address, email address & phone number to them on 2 letters now)!

Good luck with that - not that you will need luck though!

Considering the information on your model and the fact that HP released a BIOS update to try and eek more life out of the laptop I would say that rather than try and defend your claim they should trip over themselves to settle.

Their position in this case in indefensible and they cannot possibly have a defence.

Keenan rang from HP and offered me a standard repair, funny it's now being dealt with HP's solicitors! He said it was out of warranty, I countered it's not a warranty case, it's a Sale of Goods Act issue, so after stating a few facts about bios updates to keep the fan running and Nvidia admitting liability, he wasted both my time and his. What an unorganised outfit HP are. Now waiting for their solicitors, who are contesting my claim in full, to finally back down before the court date
