No No NO ........ read all the threads on here and else where ........ do not accept a partial refund !!! you are entitled to your money back or a suitable same spec replacement .

As for the " they have treated me well" they most certainly have not !

Stick to your guns ....... point out the number of people they have all ready given full refunds to on this site alone .......

You will probably need to issue a small claims to win so start it off asap

Good luck and keep at it

Ralph

their reasoning is that I have already had 2.5 years use out of it and therefore should pay SOMETHING for what I've already had. The Sale of Godds act does say

Quote:
• If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit

I am planning on reminding them of all the times its been in, it's been a right pain in the a??e TBH.

I am in a similar position with Staples who have offered a replacement laptop but have reduced the value to cover benefit of usage. I have rejected this as I do not believe I should have to contribute towards the replacement of something that when sold to me was not fit for purpose. I am awaiting their response.

I would certainly agree with Ralph and Paul that you should reject the partial refund.

I have also sent off a message to Consumer Direct via their website to ask for further information about the partial offer issue as it relates to my case (which seems pretty typical) and what my rights are with regard to the credit card company (as I paid for the laptop using my credit card), and how best to approach them - if appropriate.

I'll keep the forum updated.

Definitely do NOT accept a partial refund. Please see my main posts in which you'll see that by persevering the retailer (Staples in my case) finally gave a full refund as we almost reached the point where I was lodging my court papers.

I recently was offered a partial refund (around £100 shy of original purchase price) from PCWorld and accepted this via transfer to my bank account. The money has been recieved although nothing was put in writing. I still have the laptop and they have not asked for it back.
Do you think I have a case to pursue the rest of the purchase price? I have only recently discovered this website and had I have known about it before I would have have the clout to demand a full refund.

How long ago did you purchase the laptop? In discussion with PC World just now about getting my money back.

Hello Darthbane2k and welcome to our forum.

Firstly, well done on securing a refund :D

To be honest I wouldn't bother pursuing the balance of the purchase price.

The courts will probably say that you have had a good deal.

You also have to allow a bit for usage.

The fact that you still have the laptop is also a bonus.

In their faulty state they fetch good money on Ebay.

Well done again though.

Best wishes

Paul
