Hi,

I'm new to the forum after stumbling upon it after a google search regarding the problems described that are evident in my TX2130ea purchased for £699 in Aug. 2008 from Tesco. I am going to proceed with the OOW form since the laptop is completely dead and anything gained is a bonus. I was reading cushleys case with great interest and wondered if there was any updates regarding his claim?

It's about time people banded together and stood up to this problem against retailers that think they can take advantage. Keep up the good work guys!

I'm still waiting for a court date having filed a claim and Tesco submitted a defence its been 2 weeks since I sent the allocation questionaire ,so I don't know whether I can chase it up or not yet?

I'd suggest waiting a bit longer. A number of courts are currently working at 10 or more days in arrears so there's a good chance it'll be a week or two before you hear anything.

It might help if I explain roughly what a court does when it receives an AQ:

The first thing to remember is that a court can't do anything with an AQ until they've either received them from both parties or the time for filing them has expired.

Once they're in one of these positions they get the court file out for your case and send it to the District Judge for directions.

The DJ decides what's going to happen and sends it back to the office for the order to be typed up.

At this point the clock is reset - so, if the court is 10 days in arrears, then it means the file will go to the DJ 10 working days after receipt. The DJ may hold onto it for a day or two before sending it back and then it will go to the bottom of the pile again until the court is working on that day's work (another 10 working days) - around a month :( . If the DJ has directed that it is listed for a hearing date then this could delay it again if your local court is one of the larger ones as they tend to have a section to book hearings.

Unfortunately there are a few tasks that are 'split' like this. However, you're not likely to come across any more of them when dealing with a case following the Small Claims track. :)

When the courts have recieved the AQ's the file gets sent to the judge who takes a brief look at it and allocates it to a 'track' (it will normally be the Small Claims track for these cases).

The member of court staff you spoke to will have looked on the computer and seen that there was an event logged to say that it had been sent to the judge.

The odds are that it's come back from the judge and is sat in a pile of work waiting to be listed for a hearing & the order drawn up and sent out.

That is a good attitude to take, although it is unfair that you should have to go through al this just to get your rights under the Sale Of Goods Act.

The sad thing is that a lot off people mentally write off the laptop and just go and purchase another. I think that is wrong and unfair.

Hopefully your case will come to a conclusion pretty soon.
