I purchased my Dell XPS1330 in June 2008 in the UK.

My PC has now failed with the Nvidia defect.

My question is whether anyone has succeeded in obtaining a refund from Dell.

I know that they have issued a limited extended warranty and that my laptop is still covered. My friend had his motherboard replaced on an identical machine and that replacement is now running hot and he expects it to fail soon. It's clear that Dell are not fitting a solution, merely a replacement repair to see it out of warranty.

Having read all the posts it's clear that I have a right of replacement, has anyone achieved this with Dell?

Hello Laurie and welcome to our forum.

Sorry to hear of the problems you are experiencing with your laptop.

I have not heard of anyone getting a replacement from Dell, but that doesn't mean that it cannot happen.

Dell, like any other retailer, has obligations to you under the Sale Of Goods Act and you should tell them that, if they insist on a repair, that you want the following written warranty:-

"The mainboard being used to repair your laptop is from a completely new batch and is 100% free of the Nvidia defect. If, at any point in the future, it transpires that the mainboard is inherently defective due to the Nvidia GPU, then a refund or replacement laptop will be offered"

If they are not prepared to give you such a written guarantee then you should tell them that you have no confidence in the repair they are offering.

If they then tell you there us nothing else they can do other than repair it then you should ask for the name and address details of where legal documents can be sent.

Once you have this you should send them an initial letter before action, a template is available in the downloads section of this forum and that is here:- letterbeforeaction.pdf

You should download that, edit it with your details and send it to the address they supplied you. Please ensure that you send this via recorded delivery and keep a copy of the letter and postal receipt.

This gives them seven days to respond in the positive. If, after that time they have not responded, then you should proceed with an engineers report - the costs of which can be recovered from Dell.

Once you have the report you should send a copy to Dell giving them a final seven days to respond. If, after that time they have not responded in the positive then you should pop on over to www.moneyclaim.gov.uk and launch a small claims action against Dell.

If your laptop is indeed inherently defective then you really cannot loose.

Laurie, did you have any success with Dell on this? I have just had this problem start happenning on my Dell XPS M1330 in the last week, and am also based in the UK. I am interested in hearing how you got on. My machine is just over two years old.
