hi all. just to update, despite 2 calls to Churchill's in both of which they promised me a letter confirming the status of my original claim, I have yet to receive anything.
i think this one is a lost cause, especially as the last lady commented that my claim file was the slimmest she'd ever seen! she said she didn't have a specific reference to my original pavillion laptop or the one which the source purchased from Curry's on their behalf to replace it.
perhaps they looked up this website - you might be getting well known by now!
looks like I'll just have to take this one on the chin.
so do i bin it or pay for a repair?

The big problem here is always going to be who (if anybody) you can issue a claim against.

To work this out I think you'll now need to start thinking about legal advice.

Bear in mind that some solicitors offer a free initial half hour consultation - if you want to take this further then it might be worth seeing if any of your local solicitors offer this.

As Paul always advises - repairs are not normally worth it as there of numerous reports of them failing due to there being no viable alternative to the defective GPU.

Hello Jakesway,

Are Churchills willing to give you written confirmation that the laptop is yours and was purchased by The Source on your behalf?

If so then I would pass that on over to Currys and tell them that they are placing an unfair restriction on you if they refuse to accept it.

Now, if you pursue it in this way then you may not get a refund as technically you were not the purchaser, but you could chase a replacement laptop.

If they refuse to comply then I would still proceed to litigation.

You can prove that Currys, in a roundabout way, sold the laptop which is your property.
You can prove that the laptop is inherently defective.

If it were not for the fact the The Source had ceased trading then this would have been much easier to sort out.

Whilst it is not as cut and dried as most cases you still have the potential to win.

I would not accept a repair to your laptop due to the unavailability of reliable parts.

After numerous calls, I received a letter from Churchill's, but it doesn't link mention my particular computer, just says they settled a claim by replacing a laptop via The Source who are now no longer trading.

So, how much for a repair from your very good selves?

sorry, just read the bit about there being no viable repair. so I guess it's now become that expensive doorstop! I'd still like to thank everyone who gave their time and advice.

That is totally unacceptable and I would not accept their reply.

Churchill were the ones who sourced the laptop or you, not the other way around. You did not chose to shop at The Source, Churchills forced you to shop there.

Just so you know, The Source was a company that went bust a while ago and they provided a service for insurance companies.

I am sure they were a spin off from a company called Rapidsource.

I would get back in touch with Churchills and tell them that their response is totally unacceptable and that you will be issuing a small claims action against them unless they resolve your situation.

Had they sent you a cheque and had you then, on your own volition, shopped at The Source then the situation would have been different.

This is not your fault and Churchills must remedy it or off to court you go.
