I've just e-mailed Nick Wilson CEO (hopefully still the right one) so we'll see.
I've mentioned Sales of Good Act - satisfactory quality, inherent defects etc etc. So we'll see.
It was a pretty powerful e-mail without being nasty so we'll see. Fingers crossed. I will let you know (if I'm allowed to)

Hello Lee,

I took a look at the link you provided but I think you may have got a little confused.

With regard to debit card chargebacks it states:-

Quote:
It applies to all debit cards for goods costing less that £100, although exact rules may vary between the Visa, Maestro and American Express networks.


It further states the following:-

Quote:
Chargeback can be used in cases of goods not arriving, arriving damaged, arriving not as described, or where the merchant has ceased trading.


The failure of your laptop and the fact that Comet has ceased trading are not covered with the above. Where it talks of a merchant ceasing trading it means ceasing trading before you have received the goods.

It also states on that link:-

Quote:
Chargeback doesn't mean there is joint liability on the card company. Claims must be addressed to the bank that provides your debit or credit card, which in turn will put in a request to the merchant's bank.
As a result, you could get your money back from the merchant's bank if the money is there to be recovered.


As Comet are in liquidation then there is no money at their bank to be recovered.

Finally it also states the following:-

Quote:
Shop/online purchase In the case of tangible goods that you've purchased from a high street shop or an online retailer, the time limit would start from the day you receive your items.


So, as it states above, "....the time limit would start from the day you receive your items."

Sorry Lee but HP really are the last chance saloon.

Yes I replied to that one before. It said 120 days from the date you discover the problem. However below that it reads tangiblegoods would be from date of purchase effectively. Typical. They always use c. cards too. Typical one time you need them they didn't use them. lol.
I'm guesing I won't need an independent report if I'm dealing directly with them. I'm also guessing they can't charge me inspection fees etc.
I'm also hoping they don't insist on a repair as I'm not confident in it's reliability.

Hello Lee,

You are quite correct in that you will not need an engineers report as HP, if they do offer a resolution, will inspect the laptop themselves. The also should not make a charge to inspect the laptop.

The offer of a repair will probably be the best offer that they make as they are under no obligation to either replace or refund the cost of the laptop as you have no contract with them.
