I go into Comet in MK this tuesday coming to collect my brand spanking new Sony Vaio....Comet backed down after I issued at the county court.

Bet you £20 they back down before court.

Have they entered a defence yet?

I would be interested to know what their defence is.

Like Hannahbtw, their defence will probably be that they have offered you a replacement letter
via a letter that never arrived.

hi paul, well their initial defense was that they offered me a repair at the 11th hour :lol: lol.
The stage we are at now is that i have received the court date and directions to send all documents that i will rely on in court to comet and the courts, no later than 2 weeks prior to the 21st of october, so i guess comet will keep me waiting for another few weeks yet.
I have a 150 page case file put together and i cant wait to see what they put forward, i guess it will be along the lines of "we have adhered to the terms of the SOGA by offering a repair"
What i was looking for hannah was a few case specific details that i could quote to the judge if comet denied giving anyone a replacement or refund, not crucial to my case, but every little helps ;)
Hannah, i hope that vaio isnt running on green :o

I know you read this page comet group, if you are thinking of going for an out of court settlement at the 11th hour then it will only be accepted for the full amount plus costs as claimed for.

Hello Hairy,

What would be good for you would be to get some proof of prior settlements with Comet but not to
let them know you have this.

Then, when in court question them about this.

If and when they deny it you can then introduce your evidence into court.

If they have lied then the courts will naturally judge in your favour.

Just a suggestion Hairy, but I like the fact that you have 150 pages of evidence.

They won't know what's hit them when they get into court. :lol: :lol:

Yes it has cost a packet in ink because it has to be in triplicate :o
As for not disclosing evidence, i think the judge would just say it was inadmissable because the other party had no prior knowledge ?
I will get my detective head on and do some digging for some prior settlements, watch this space ...................

Out of the successes with Comet so far, did they all result in a voucher to use at Comet?
I only ask because we need the computer at home now, and it's obviously going to take a while to get a result out of Comet - leaving me needing to buy a replacement now.

I'm assuming under SoGA they can provide a replacement or a voucher, rather than having to pay cash?

Hiya NDT,

In my case they asked me to bring the faulty laptop into store, which I then exchanged for a new one, with the difference put onto a Comet Gift Card. So no cash or vouchers as such. I was able to claim the full original purchase price to put towards a new laptop, which they then scanned, gave me a receipt for and the extra £150 was scanned onto the gift card. I would still shop at Comet after this, as although they went around the houses a bit before conceding, they did come good, and essentially it was the Nvidia chip that caused all the problems initially, not Comet.
Comet are a pain, but a pain that can be rectified IMO :)
