Hi everyone, I've been following this forum and a few others the last few months just I havent had time to do anything about my laptop.

I bought my TX1250ea at Staples UK as soon as i got to England in September of 2007 thinking it was a perfect laptop for me, but a year later it died completely and had it sent to get repaired in July 2008 under warranty luckily. But since then, and before, I've had various problems including all the ones mentioned on this board. so about July time my laptop was failing me again and again so a bout another laptop.

so now i want to fight against hp/staples to replace or refund the faulty laptop they gave me.
I have tried calling and emailing HP several times to no avail of course, and so now i will be calling staples, I just don't know how to go about it?
any suggestions?

Hello Zammitj and welcome to our orum.

Sorry to hear of the problems you are having with your laptop.

You purchased your laptop from Staples so it is they who you need to chase.

You have no contract with the manufacturer, HP, so don't waste your time calling them as they will not be able to help you.

You need to contact Staples and tell them that your laptop is inherently defective and has failed because of a defective Nvidia GPU.

They may tell you that you are out of warranty. You should tell them that you have six years from the date of purchase to take action where the goods are inherently defective.

They will then probably tell you that you need to get an engineers report.

When they do, please let me know because that is a service we provide. The cost of the report can be recovered from Staples.

So, you need to start by phoning them. Ask for their head office number in the UK.

Don't let them fob you off and be persistent.

If you read through some of the posts in this forum you will see how successful we have being in helping to secure refunds or replacement laptops.

ok so just called and they said i need the engineering report, so what do i do with that, i know i send it to you but how and where and how long will it take?

Hello Zammitj,

The cost of the engineers report is £65 which includes the collect and return carriage.

This cost can be recovered from the retailer.

In order to proceed with the engineers report please do the following.

1) Please go to http://www.lapcure.co.uk/register.php

Complete the registration page and then verify your email address.

2) Once you have done that please then login to the site and click on the
"Add a job" link.

Fill in details about your laptop and then once you are sure the details are
correct please save the record.

Once you have done that the courier will be booked to collect the laptop the
next business day.

We use DHL for the collect and return carriage.

Please ensure that laptop is securely boxed with sufficient packaging to
withstand transit to ourselves.

Once you have booked your laptop in I will email you with the label to place
on the box.

Payment is not due until the report is ready.

I will email you a PDF copy of the report and will include 3 copies of the
report and invoice with your laptop.

If you have any questions or queries then please do not hesitate to contact
me.

ok so great news, sort of.
I got a reply to my situation and they have offered me an exchange at the staples store.

but i wanted a refund as i have no use for another laptop so what can i do?

This is the email they sent me when I asked for a refund,

"A full refund is not likely i'm afraid, our policy is to repair if possible, replace if not and only if we do not have a suitable replacement would we consider refund. If a refund was considered it is would be minus usage and depreciation of the unit. The issue of the report is not relevant as you would be able to get a cheque refund for the cost of that. I will make the arrangements today."

anything i can say to get them to give me a refund?

Hello,

Well, it certainly seems a fair offer.

If you were to get a refund, and take into account any usage you had, then the value of such refund could be less than the cost of the replacement unit they are offering.

You can argue that you want a refund as you have now had to purchase an alternative unit, but as I said, you may come off worse.

I would take the replacement unit and put it up on Ebay. Should fetch decent money.

Ok so just to update everyone on whats happening and my decision...

So got my laptop sent to Lapcure then returned around a week or so then send the report with a cover letter to Staples Uk customer services and waited 5 days and called them up asking what they had on my case.

The woman on the phone said she received it and remembered it and saw that the report was from lapcure and said they had many successful reports with it and she would take a close look at the case the next morning.

And she did and sent me an email saying that I can go to the local Staples store and talk to the manager to get my replacement.

I wanted a full refund but as the product is over 2 years old the deprecation of the product wouldnt give me anything close tot he value of what i bought it for. so now im waiting for the managers reply to exchange the laptop for another product or wait till staples gets new stock of new laptops as their current line up is pretty crap.

So all in all a great success, though I wanted to much out of it in the first place.
So thank you Lapcure for the support and help and thank you staples for great service, and no thanks to HP for any help in this matter.

Staples comes good again - I know where I'm going to be buying my next laptop from!
