Hi Paul,
I to am an owner of a hp pavilion thats failed ,definately the nvidia card overheating. DV9340e geo force 7600.
I phoned comet , spoke to the supervisor (manager not there) only to be told to contact hp, despite quoting the sale of goods act to him.

Secondly, i wrote your "letter before action" to comet head office (Hull) recorded, on the 28th June, I have recieved no reply at all, What are my next steps please, Paul

Hello Peter and welcome to our forum.

Sorry to hear that your laptop has failed.

Does anyone at Comet know anything about the law?

From the store level staff right up to the Supervisors it appears that they know as much about the Sale Of Goods Act as I do about Thermo Nuclear Physics.

They are, in my opinion, a thoroughly unprofessional company who appear to think nothing about the way their customers are treated and will make them jump through hoops in order to secure their legal rights.

You should not let them fob you off in this way and should keep in mind that you are in the right, Comet are in the wrong and the law is on your side.

The good news is that your model of laptop is one of those that HP issued a BIOS update for to switch the fans on continuously.

This was done after negotiations with Nvidia to try and find a way to prevent the laptop from overheating.

On the 25th February 2008 HP released a BIOS updated named F.2B and the purpose of this update, according to HP, was:-

HP wrote:
Updates the fan control algorithm of the system to reduce the likelihood of future system issues.

Looking further into the HP support site it also states the following:-

HP wrote:
“The new BIOS release for your notebook PC is preventative in nature to reduce the likelihood of future system issues. The BIOS updates the fan control algorithm of the system, and turns the fan on at low volume while your notebook PC is operational”


This update was only a "band aid" fix and whilst it did make the laptop run slightly cooler it did not remove the inherent defect that your laptop contains.

Furthermore, as HP MUST have known prior to the 25th February of the inherent defect that your laptop contained then they should have contacted yourself and other owners of the same model to offer a resolution. Had they done so then the laptop would still have been under warranty. Furthermore, as you would still have been within the first six months you could have legally opted to have the laptop replaced.

They didn't do this and so placed you in the position you are now.

As you have had no response to the letter before action you should now proceed to obtain an engineers report which will hopefully prove that your laptop is indeed inherently defective.

Once you have that you should send Comet a copy along with a final letter before action.

If after seven days Comet remain incommunicado then you should waste no more time on them and should proceed to file a small claims action.

The BIOS update that was released for your laptop is excellent evidence and will go a long way to proving your case.

If you follow my advice in that guide then you will be successful.

The key to success is persistence. Stand your ground, stick to your guns and never, ever let Comet fob you off and you will win this case.
