Well, the kind people of Comet responded to my letter today stating that the basically it is not there problem and the fact that the laptop has worked for 3 years clears them of any manufacturing defect when sold under the Sales of Goods Act.

They do kindy offer to repair the laptop on a chargeable basis but then go on to say that if I can prove with documented evidence that the laptop was faulty at the time of sale they will investigate further.

Is this the usual response which leads to a report being submitted?

Hello Fraser,

Yes, that is a typical response from Comet so you should not worry.

They are factually incorrect when they state that because "the laptop has worked for 3 years then this clears them of an manufacturing defect when sold under the sale of goods act." as the Sale Of Goods Act gives you SIX years in which to make a claim.

I don't know who they get to write their letters but they really need to brush up on the basics of the Sale Of Goods Act.

Your next step is to provide them with an engineers report which hopefully will show that your laptop is indeed inherently defective.

Apologies for the delayed reply been busy at work.

Anyway yeah I'll go through yourself for the engineers report if that is ok. As previously mentioned my neighbour is an IT engineer but he is unsure of what is required in the report.

Just let me know what the next step is and what is needed.

Received my reply from Comet today via e-mail following my engineers report and reply letter.

As follows;

Dear Mr Grant

Further to your recent letter.

I have passed a copy of your 3rd party report to our dedicated repair agents Hewlett Packard.

After reviewing this matter further with our repair agent, I can confirm that we would repute your claim. The issues that you have reported with your product could be due to a number of reasons in particular in aged units and do not constitute a manufacturers defect.

Taking this into consideration any repair undertaken would be a on a chargeable basis.

Having reviewed the entire matter, while I am of course very sorry that you disagree with the information in our previous correspondence, I am satisfied that it is correct and am therefore unable to help you any further on this matter.

Please accept my apologies for the inconvenience you have been caused.

Did you obtain a report from ourselves or from elsewhere?

If you obtained one from elsewhere then please could you let me know the contents of your report.

If you obtained from ourselves what is the RMA number?
